Introduction

An unannounced follow-up inspection was completed today. The inspection is in response to contraventions identified at the routine inspection #CLAN-CD8M9B

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: The name of the Manager was not displayed. This was not corrected by the date specified on the routine inspection. This is a repeat contravention.
Corrective Action(s): Please ensure the Manager's name is posted.

LICENSING: 10070 - CCLR s.11(4) - A licensee must display in a prominent place in the community care facility the certificate, or a copy of the certificate, of any educator or assistant employed to work in the community care facility.
Observation: One employee who was working at the facility did not have her ECEA certificate posted. This was not corrected by the date specified on the routine inspection. This is a repeat contravention

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: A loose cord to a humidifier was not secured. This was corrected during the inspection. This was not corrected by the date specified on the routine inspection. This is a repeat contravention

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: Licensing observed that landscape fabric was exposed in the outdoor play area. This could present a potential tripping hazard. This was not corrected by the date specified on the routine inspection. This is a repeat contravention

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11090 - CCLR s.15(1)(b) - A licensee must supply equipment, furniture and supplies that are (b) located so as not to block or hamper an exit in the case of fire or other emergency.
Observation: The emergency exit door was locked. When asked by Licensing, the staff retrieved a set of keys the Director had given them for the emergency exit. Licensing asked the staff to open the door. The keys did not work. The staff member contacted the people upstairs and received a key for the door and opened the door. The key was hung on the door hinge to the emergency exit. This serious health and safety risk to children was discussed. This was not corrected by the date specified on the routine inspection. This is a repeat contravention
Corrective Action(s): Please ensure the emergency exit remains unlocked and that staff are aware of where the key is located.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: The laundry room door was unlocked. Inside the laundry room was a loose rope, and a chemical cleaner.
Corrective Action(s): Please ensure the children do not have access to any objects or substances that are hazardous to their health and safety. This was not corrected by the date specified on the routine inspection. This is a repeat contravention.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: A staff member in the facility did not have a Criminal record check. This is a serious risk to the health and safety of the children in care

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: An employee at the facility did not have character references.

STAFFING: 12070 - CCLR s.19(1)(d) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (d) copies of any diplomas, certificates or other evidence of the person's training and skills.
Observation: One certificate was not obtained.
Corrective Action(s): Please ensure staff records are complete prior to the first day of work at the facility and that the records are on site for review

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Immunization status was not obtained for one employee.
Corrective Action(s): Please ensure staff records are complete prior to starting the first day of work at the facility and that this is available for review.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: Staff records were reviewed and one staff did not have a verification for their certificate on file. This was not corrected by the date specified on the routine inspection. This is a repeat contravention

STAFFING: 12180 - CCLR s.22(2)(a) - A licensee must ensure that each employee (a) is trained in the implementation of the fire drill system and emergency plan described in subsection (1), including the use of any equipment noted in the fire drill system and emergency plan.
Observation: During the inspection Licensing asked staff where the emergency evacuation supplies were located. The staff did not know where the supplies were located. This was not corrected by the date specified on the routine inspection. This is a repeat contravention

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must: (b) have an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: The fire extinguisher was due for servicing on November 11, 2022. The fire extinguisher was observed as being within the area of fully charged. This was not corrected by the date specified on the routine inspection. This is a repeat contravention.
Corrective Action(s): Please ensure the fire extinguisher is serviced on an annual basis before the expiry date to be able to respond in the event of an emergency.

NUTRITION AND FOOD SERVICES: 17120 - CCLR s.48(6) - A licensee must make available to parents information on the food and drink given to children.
Observation: The food menu was observed at the facility. The menu was written in Chinese characters. The food menu must be written in English as well as Chinese characters. This was not corrected by the date specified on the routine inspection. This is a repeat contravention

PROGRAM: 18030 - CCLR s.44(1)(c) - A licensee must provide to children a comprehensive and coordinated program of indoor and outdoor activities that (c) complies with the program standards set out in Schedule G.
Observation: During the inspection licensing observed minimal toys for the children in the facility. The staff showed licensing two bags of toys in the closet . These toys were more suitable for children from 0-36 months. Most children in attendance are over 3 years old. This was not corrected by the date specified on the routine inspection. This is a repeat contravention
Corrective Action(s): Please ensure a coordinated program of indoor activities and materials is provided to the children in care that complies with Schedule G of the Child Care Licensing Regulation.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.

RECORDS AND REPORTING: 19320 - CCLR s.59(a) - In respect of a record referred to in this Division, a licensee must (a) keep in a single place at the community care facility the records referred to in sections 56 to 58.
Observation: Licensing observed that the Manager's staff record and the policies and procedures were not at the facility. This was not corrected by the date specified on the routine inspection. This is a repeat contravention.
Corrective Action(s): Please ensure the Manager's record and the facility policies and procedures are on site and available for review to comply with the legislation.

Comments

At the inspection dated May 13, 2022 there were 7 children, and two staff were present. At this inspection the above noted repeat contraventions were identified. Please correct the above noted contraventions by May 25, 2022 , unless otherwise specified in the report. Please submit a written response to Licensing by May 25, 2022 stating how you have corrected the above noted contraventions. A follow up inspection is required and will be completed at a later date.
