Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act(CCALA) and the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DoLSoP). All care categories were inspected for compliance.

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Licensing observed the following:
- a plastic bag left behind the garbage can in the outdoor play area. (CORRECTED DURING INSPECTION)
- the children's bedding was stored all together. The Manager said they have ordered bins to separate the children's bedding
Corrective Action(s): Ensure a healthy and safe environment at all times.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: A random selection of staff files were reviewed. Out of the 3 reviewed, 1 did not have a site specific criminal record check. The Manager said an application has already been submitted for this staff.
Corrective Action(s): Ensure a current, valid and site specific criminal record check has been obtained for all employees.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: A review of the attendance record found the following:
- When asked how many children were in attendance a staff said 20. A head count indicated 17 children.
- All 17 children were in the PreK-1 room. However, the sign in/out indicated children were signed in at both rooms, Pre-K1 and Prek-2.
Corrective Action(s): Ensure an accurate record indicating whether the child is absent, present, and the time of arrival and departure is on file.

RECORDS AND REPORTING: 19160 - CCLR s.57(2)(i) - A licensee must keep, for each child, a record showing the following information: (i) a photograph or digital image of the child, and other information that can be used to readily identify the child in an emergency.
Observation: A random selection of children's files were reviewed. Out of the 3 reviewed, 1 did not have a photograph.
Corrective Action(s): Enusre a photograph or digital image of the child is on file.

RECORDS AND REPORTING: 19200 - CCLR s.57(3)(b) - A licensee must have in writing from a parent, and maintain at the community care facility, consent (b) to release a child to someone other than the parent.
Observation: A random selection of children's files were reviewed. Out of the 3 reviewed, 2 did not contain information for an alternate pick-up. The Manager said the 2 children are new to the facility.
Corrective Action(s): Ensure there is consent from a parent to release a child to someone other than the parent.

Comments

Summary of Inspection:
At the inspection dated June 24, 2022, there were 17 children in care with 3 teachers.
At this inspection the above noted contraventions were identified.
Action required by the licensee includes providing a written response by June 30, 2022 .
Actions required by Licensing include reviewing the written response.

The following education was provided:
Covid-19 vaccine status for staff
Documentation in the minor incident log book to include the 5 W's (who, what, where, when, why, how)
The gate in the outdoor play area was locked. A discussion was had with the Manager to ensure the gate is unlocked during the hours of operation so there is a point of egress in the event of an emergency.
There are bolt locks on the top and bottom of the door that leads to the outdoor play area. A discussion was had with the Manager to ensure these are kept unlocked during the hours of operation to ensure a fast emergency evacuation.
Review of Legislation around having no more than 2 children between 30 to 36 months of age.

This report was written off site and a copy of both the report and Risk Assessment was emailed to the facility. This report is unsigned due to health and safety practices during COVID-19.
