Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSOP). Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.

As part of the routine inspection a Facility Risk Assessment Tool is completed and a copy is provided. The Risk Assessment includes non-compliance identified during the routine inspection and a 3 year “historical” review of the facility’s compliance and operation.

Contraventions
Previous Inspection - Contraventions observed on FIR #IMAY-AKWRMV have been corrected except for those noted on supplementary pages.
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Licensing reviewed 5 staff files and observed that record of criminal record check (CRC) clearance letters were missing for 2 staff.
Corrective Action(s): Please ensure that criminal record checks have been completed prior to employment and that CRC's are renewed every 5 years. Licensing is requesting a compliance plan.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation (CORRECTED DURING INSPECTION): Licensing reviewed 5 staff files and observed that record of immunization status was missing for one staff.

On February 16, 2018 the licensee provided evidence of the staff member's immunization status.
Corrective Action(s): Please obtain, from each staff, record of their immunization status prior to employment.

STAFFING: 12260 - CCLR s.29(c) - To qualify for employment in a community care facility as a responsible adult, a person must (c) have completed a course, or a combination of courses, of at least 20 hours duration in child development, guidance, health and safety, or nutrition.
Observation (CORRECTED DURING INSPECTION): A staff member was hired to work in ratio as a responsible adult (RA) in the school age program. However, Licensing was made aware that the staff member was hired while they were completing their 20 hours of courses. Licensing advised that RA's cannot work in ratio until all criteria's listed under section 29 of the CCLR have been met. Compliance options have been discussed.

On February 16, 2018 the licensee provided proof that the staff member had completed their responsible adult status.
Corrective Action(s): Please ensure staff have appropriate certification prior to employment.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must have all of the following: (b) an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: Licensing observed that the fire extinguishers were due for servicing in February 2017. The manager advised that an appointment has been made to service the equipment.
Corrective Action(s): Please ensure that fire extinguishers are serviced annually to ensure that equipment used to respond to and recover from and emergency situation are working properly.

HYGIENE AND COMMUNICABLE DISEASE: 15010 - CCLR s.14(4)(a) - A licensee, other than a licensee who provides a care program described as either Preschool (30 Months to School Age) or Group Child Care (School Age), must have in a community care facility a sturdy surface for changing diapers, located outside the food preparation area, next to (a) a covered container for soiled clothing.
Observation: The container for soiled clothing in one of the bathrooms does not have a cover. This is a repeat contravention as it was identified on the last routine inspection (IMAY-AKWRMV).
Corrective Action(s): Please ensure containers for soiled clothing have containers.

Licensing reminded the manager that care plans are up for review this year for 2 children in care (April and May).

Please provide a compliance plan for coded item 12040.
