Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.
The following areas were reviewed:

· Physical Facility (outside was not inspected at this time, due to snow coverage and access)

As part of the routine inspection a Facility Risk Assessment Tool is completed and a copy is provided. The Risk Assessment includes non-compliance identified during the routine inspection and a 3 year “historical” review of the facility’s compliance and operation.

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: It was observed that an outlet cover in the preschool classroom is loose, Licensing was able to lift and move the cover, exposing the wiring. It is at a height that is accessible to children.
Corrective Action(s): Please ensure that the outlet is secured to ensure that the wiring is not accessible to children.

HYGIENE AND COMMUNICABLE DISEASE: 15030 - CCLR s.46(1) - A licensee must establish a program to instruct children in, and to practise the rules of, health and hygiene.
Observation: Licensing observed that the children were given their lunch without washing their hands. the children had been sitting on the floor for circle time following an art activity. The staff stated that they would usually help the children to wash their hands but one staff left the room at this time. Another staff person used baby wipes to help the children clean their hands once identified by Licensing.
Corrective Action(s): Please ensure that a program to instruct children in and to practice the roles of health and hygiene.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Licensing observed that 10 children were signed in but only 8 children were present in the room. Staff stated that 2 of the children were attending the other program for the day as the staff was in the other program. Upon review of the other sign in sheet, the children were signed in to 2 programs at this time and did not accurately represent which program the children were present.
Corrective Action(s): Please ensure that the attendance records for all children accurately represent where the child is at the time of day. The record should accurately represent whether the child is absent or present and the time of arrival and departure.

RECORDS AND REPORTING: 19160 - CCLR s.57(2)(i) - A licensee must keep, for each child, a record showing the following information: (i) a photograph or digital image of the child, and other information that can be used to readily identify the child in an emergency.
Observation: Licensing observed 4 children's files and it was found that 1 of the children's photograph was 2 almost 3 years out of date, the photograph was taken when the child was an infant. In an emergency the child could not be identified. The Manager was aware that some of the files are out of date and photographs or a digital image will need to be updated. The Manager stated that they have requested a printed image from the parents. Licensing discussed that a digital image is acceptable or a photograph.
Corrective Action(s): Please ensure that each child has a photograph or digital image that allows the child to be identified.

RECORDS AND REPORTING: 19240 - CCLR s.58(1)(c)(ii) - A licensee must keep, for each child requiring extra support, a current care plan showing the following information: (c) the resources to be made available to the child requiring extra support by the licensee, including (ii) any modification to the program of activities necessary to enable the child to participate in or benefit from the program.
Observation: Upon Licensing arrival Licensing identified a modification of the program of activities to support the children in the program. The Manager stated that the parents and Staff verbally agreed to modification of the program for the benefit of the child(ren), but there was no written record available. The equipment in use could be considered a restraint.
Corrective Action(s): Please ensure that any modification of the program of activities is supported by a care plan showing the directions given to staff to enable the child to participate in or benefit from the program.

Comments

Licensing discussed the use of high chairs as a form of discipline. A staff stated to a child climbing a toy (2 times) that they would put the child "into a high chair if they didn't listen". When asked about the statement, the staff said that they were joking and would never do that. Licensing discussed the appropriate use of a high chair ie: for eating. This was also discussed with the Manager.

Licensing note that there are televisions present on many of the classrooms. A discussion with the Manager regarding the Director of Licensing Standards of Practice: Active Play which will be a requirement as of September 2017, in addition policies for Active play and screen time ill be required at that time. A copy of DLSoP: Active play was provided for their reference.
