Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA) and the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DoLSoP). All care categories were inspected for compliance.

Observed Violations
STAFFING: 12010 - CCALA s.7(1)(d) - A licensee must do all of the following: (d) appoint a manager for the community care facility.
Observation: Staff informed Licensing Officer that the previously appointed Manager has not worked at the facility since the end of June 2021.
Corrective Action(s): Ensure to appoint a manager for the community care facility.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Two of the three staff files reviewed did not include a criminal record check.
Corrective Action(s): Ensure to obtain a criminal record check prior to employment.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: One of three staff files reviewed did not include character references.
Corrective Action(s): Ensure to obtain character references prior to employment.

Observation: One of three staff files reviewed did not include a record of the person's work history.
Corrective Action(s): Ensure to obtain a record of each staff's work history prior to employment.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Two of the three staff files reviewed did not include immunization status.
Corrective Action(s): Ensure to obtain immunization status for employees prior to employment.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation (CORRECTED DURING INSPECTION): Two of three staff files reviewed did not include certificate verification by the Early Childhood Educator Registry. A staff obtained verification during the inspection.

RECORDS AND REPORTING: 19030 - CCLR s.55(2)(a) - A licensee must notify the medical health officer within 24 hours after (a) a child is involved in, or may have been involved in, a reportable incident described in Schedule H while under the care or supervision of the licensee.
Observation: Licensee did not notify the licensing officer within 24 hours that a child was involved in or may have been involved in a reportable incident as described in Schedule H as required.
Corrective Action(s): Ensure to notify the licensing officer within 24 hours that a child was involved in or may have been involved in a reportable incident as described in Schedule H as required.

Comments

During this inspection, the above noted contraventions were identified during the inspection. As part of this Routine inspection, a Facility Risk Assessment Tool was completed.
The information contained in the report was discussed with a staff and the report and risk assessment were written off-site. Licensing emailed a copy of the report and the risk assessment to the facility.
