Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.

As part of the routine inspection a Facility Risk Assessment Tool is completed and a copy is provided. The Risk Assessment includes non-compliance identified during the routine inspection and a 3 year “historical” review of the facility’s compliance and operation.

Contraventions
Previous Inspection - Contraventions observed on FIR #LPEN-ATSPWY have been corrected except for those noted on supplementary pages.
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
LICENSING: 10090 - CCLR s.12(1)(b) - During an investigation or inspection, a person must not do either of the following: (b) withhold, conceal or destroy any records or information relevant to the investigation or inspection or required by the medical health officer.
Observation: At Licensing Officer's arrival 3 children were located in the main play area. Licensee stated the other children were eating snack with another adult on the couch in the other room. The Licensee brought 5 children into the main play area. Licensing Officer (LO) was inspecting the outdoor area and saw a man and child hiding behind a garbage can behind the garage. Licensing Officer asked the Man if they were part of the daycare and he said no. The LO asked the Licensee if there was anyone else on the premise and the Licensee said no. The LO asked who the person and child were who were outside and the Licensee stated that the man is staying at the premise and the child is visiting. The child has a child care registration form on file. A discussion was had with the Licensee about how the maximum number of children allowed in the community care facility is 8 children. The Licensee stated she was unaware of this and that the child was just visiting. The child's parent dropped the child off in the morning and was not due to pick up until 5pm. The child joined the other children in care in the main play area.
Corrective Action(s): The Licensee must not withhold, or conceal any information relevant to the inspection.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: The following was observed:
-There was dried dog feces on the grass in the back play area accessible to children. The Licensee stated that the children were outside when the Licensing Officer arrived and she cleaned up the dog feces in the morning.
-The window in the front children's play area located on the main floor east side of the house was open with the potential for a child to fall or climb out of. Once outside the facility is located on a main street. The Licensee stated that she only opens it when the children are sleeping and she is in the room but forgot to close it today because the Licensing Officer arrived.
Corrective Action(s): Ensure that any animal feces is cleaned up prior to children accessing the area and recorded in a log of all inspections, maintenance and repairs as described in Director of Licensing Standard of Practice (DOLSOP) Safe Play Space. A copy of DOLSOP Safe Play Space was provided with the report to the Licensee
Ensure there are no potential hazards from falling or climbing out of a window. Please provide Licensing with a written plan on how you will ensure that the children do not have access to open windows.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation (CORRECTED DURING INSPECTION): Toilet cleaner, air freshener and cleaning products were located under the sink in the bathroom accessible to children. The Licensee placed a band on the door during the inspection to make the cupboard inaccessible to children.
Corrective Action(s): Ensure that all hazardous substances or objects are inaccessible to children.

STAFFING: 12160 - CCLR s.20(1) - The licensee must not permit a person over the age of 12 to be ordinarily present on the premises of a community care facility while children are present, unless the person is of good character and the licensee has obtained a criminal record check for that person.
Observation: 2 persons who were present and are ordinarily present in the community care facility do not have a criminal record check. A copy of Criminal record check bulletin was provided.
Corrective Action(s): Ensure that each person over 12 who is ordinarily present on the premises has a criminal record check from the criminal record review agency in Victoria. Provide Licensing a plan on how you will address the contravention until such time when the criminal record reviews have been completed and received.

CARE AND/OR SUPERVISION: 14360 - CCALA s.7(1)(b)(i) - A licensee must do all of the following: (b) operate the community care facility in a manner that will promote (i) the health, safety and dignity of persons in care,
Observation: 9 children were present in the community care facility at time of inspection. On May 22, 2018 attendance records show 9 children in attendance and of those 9 children 4 children were under 36 months old. Maximum capacity for an In-Home Multi-Age facility is 8 children with no more than 3 children under 36 months old. 2 children were picked up from the facility prior to the Licensing Officer leaving.
Corrective Action(s): Ensure that you are operating the community care facility in a manner that will promote the health, safety, and dignity of persons in care according to the Community Care and Assisted Living Act and the Child Care Licensing regulations.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation: 2 of 4 children's files reviewed did not contain date of enrolment. This is a repeat contravention.
Corrective Action(s): Please ensure that a date of enrolment is recorded for each child.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: 9 children were present in the community care facility today and none had a time of arrival. 4 children did not have a time of departure for June 20, 2018.
Corrective Action(s): Please ensure that each child has a daily record of time of arrival and departure.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: 2 of 4 children's files reviewed did not have the name or phone number of a medical practitioner. 1 children's files reviewed did not have the name or phone number for an emergency contact.
Corrective Action(s): Please ensure that each child has a record of name and telephone number for a medical practitioner and emergency contact.

RECORDS AND REPORTING: 19320 - CCLR s.59(a) - In respect of a record referred to in this Division, a licensee must (a) keep in a single place at the community care facility the records referred to in sections 56 to 58.
Observation: The Licensee did not have the active play, screen time policy or records of Fire drills for 2018 at the facility. The Licensee stated that the policies are on the computer and she has sent a copy to each family. The Licensee stated that the fire drill records are usually posted on the wall and that it may have been taken to the other facility to make a copy. Records for 2016 and 2017 fire drill compliance was available.On June 22, 2018 fire drill records for 2018 were available.
Corrective Action(s): Ensure that all records referred to in CCLR s. 56-58 are kept in a single place at the community care facility.

The Licensee's first aid certification expired August 2018.
The Licensing Officer had a discussion with the Licensee about not having more than the maximum capacity for children on premise at the community care facility. The Licensee stated that she will not have more than 8 children at the facility.

This report was written at the office and reviewed with the Licensee on June 22, 2018 inspection. Time spent includes time taken to write this report.
