Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Observed Violations
LICENSING: 10070 - CCLR s.11(4) - A licensee must display in a prominent place in the community care facility the certificate, or a copy of the certificate, of any educator or assistant employed to work in the community care facility.
Observation: Staff certificate was not posted.
Corrective Action(s): Ensure that the copy of certificates is displayed.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11230 - CCLR s.47 - A licensee must ensure that any heated water accessible to children is heated to no more than 49° Celsius.
Observation: Licensing observed the heated water in the bathroom exceeds more that 49 degree Celsius
Corrective Action(s): Ensure that any heated water accessible to children is not heated more that 49 degree Celsius

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Criminal Record Check for the manager and the family members is not current.
Corrective Action(s): Ensure that the CRC are current and there is a system in place to obtain them as required.

STAFFING: 12070 - CCLR s.19(1)(d) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (d) copies of any diplomas, certificates or other evidence of the person's training and skills.
Observation: Copies of certificates person's training and skills were not icluded in the file. Licensee mentioned that they have the checked the certificate.
Corrective Action(s): Ensure that the copy of certificate is obtained and included in the staff file prior to employment

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: Upon review of two files licensing observed that the certificates were not validated.
Corrective Action(s): Ensure that the certificates are verified by the system maintained by the early childhood educator registry.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must: (b) have an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: Fire Extinguisher has not been serviced annually
Corrective Action(s): Ensure that a system is in place to service the fire extinguisher annually

Comments

Summary of Inspection:
· At the inspection dated February 6, 2024 there were 7 children and 1staff present. Licensing met with the manager. At this inspection above noted contraventions were identified.

As part of this Routine Inspection, a Facility Risk Assessment Tool is completed and a copy was provided to the facility along with this report.
The Risk Assessment includes any non-compliance identified during the routine inspection and a 3 year ‘historical’ review of the facility’s compliance and operation and is used to determine inspection frequency.

The following was discussed:
- Use of log book.
- Licensing Duty line: #604 587 3936 for emergencies if area Licensing Officer can’t be contacted.
- Regular review of BCCDC website (see link below)
