Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance or all areas of the facility were reviewed for compliance with the exception of a review of the facility's Active Play and Screen Use policy which is available on-line. Licensing will review these policies when they return to their office.

Contraventions
Previous Inspection - Contraventions observed on FIR #KSEY-AS9NPE have been corrected.
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: During inspection Licensing reviewed staff documentation and noted one staff person is missing their immunization status.
Corrective Action(s): Ensure immunization status is on file for this staff person.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: During inspection Licensing reviewed staff files and noted that the renewed ECE Certificates have not be verified for staff.
Corrective Action(s): Ensure renewed ECE Certificates are verified for all staff with renewed ECE certificates.

STAFFING: 12430 - CCLR s.56(1)(b) - A licensee must keep current records of each of the following: (b) for each employee, the records required under section 19 (1) [character and skill requirements].
Observation: During inspection Licensing reviewed staff records and noted one staff person's Criminal Record Approval letter from the Criminal Record Review Program has expired.
Corrective Action(s): Ensure up to date Criminal Record Approval letter is on file for this staff person.

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation: During inspection Licensing reviewed the fire/ emergency drill log and noted the fire drill from November 2018 had not been recorded as being conducted.

Staff stated the fire drill had been conducted.
Corrective Action(s): Ensure fire drill log is up to date as proof that monthly fire drill, and the annual emergency evacuation drill have been conducted.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation: During inspection Licensing randomly reviewed 12 children's files and noted: no enrollment/ start dates noted in one class binder as well as a few children's files in other class binders.
Corrective Action(s): Ensure date of enrollment is on file for all children attending the facility.

Comments

At the inspection dated Nov. 29, 2018 there were 16 children, 2 staff and 1 duty parent present.
During inspection Licensing observed children engaged in free play which included: dramatic play; science (gravity) experiments; a light table with arctic animals; creating painting on canvas; they then had a snack time as well as a circle time with stories, music and movement.

During inspection Licensing observed staff interacting with children while they were engaged in activities, giving warnings before transitions as well as assisting with problem solving when necessary.

At this inspection the above noted contraventions were identified.
Licensee to submit written documentation (email) to Licensee once all violations have been addressed.
As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.
