Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All care categories were inspected for compliance.

Observed Violations
STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: One individual that is providing transportation does not have a valid criminal record check.
Corrective Action(s): The Licensee confirmed that only staff members with valid criminal record checks would provide transportation to children moving forward.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: One staff member's Early Childhood Educator certificate has not been validated by the early childhood educator registry.
Corrective Action(s): The Licensee confirmed that all Early Childhood Educator certificates will be validated within one week.

STAFFING: 12210 - CCLR s.23(1)(a) - A licensee must ensure that children have at all times immediate access to an employee who (a) holds a valid first aid and CPR certificate, provided on completion of a course that meets the requirements of Schedule C.
Observation: One individual that is providing children's transportation does not have a valid first aid certificate.
Corrective Action(s): The Licensee confirmed that only staff members with valid first aid certificates with provide transportation to children moving forward.

POLICIES AND PROCEDURES: 13060 - CCLR s.56(1)(d) - A licensee must keep current records of each of the following: (d) written policies and procedures that are intended to guide employees in the care and supervision of children.
Observation: Although the facility provides transportation to children, a transportation policy has not yet been created.
Corrective Action(s): The Licensee will create a transportation policy within one week. Licensing provided the Licensee with a resource.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: Licensing reviewed five children's files. Two of these did not include the child's medical insurance number.
Corrective Action(s): The Licensee confirmed that children's records would be complete within one week.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation: Licensing reviewed five children's files. One of these did not include the child's enrollment date.
Corrective Action(s): The Licensee confirmed that children's records would be complete within one week.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: Licensing reviewed five children's files. Three of these files did not include the child's name and telephone number of a medical practitioner and three of these files did not include the name and telephone number of an emergency contact.
Corrective Action(s): The Licensee confirmed that children's records would be complete within one week.

RECORDS AND REPORTING: 19160 - CCLR s.57(2)(i) - A licensee must keep, for each child, a record showing the following information: (i) a photograph or digital image of the child, and other information that can be used to readily identify the child in an emergency.
Observation: Licensing reviewed five children's files. One of these files did not include a photo of the child.
Corrective Action(s): The Licensee confirmed that children's records would be complete within one week.

Comments

This routine inspection was conducted over two days in order to assess all care categories. On the first day there were six children in care with one staff member and on the second day there were six children with the Licensee and one staff member. On the second day a walk through of the entire home was conducted, other than the separate suite located on the south side of the basement.
At this routine inspection the above noted contraventions were identified. The facility is required to take corrective action to bring the facility into compliance and provide a written response to Licensing by March 4, 2024. As part of this routine inspection a facility risk assessment tool was completed, and a copy will be provided.
The following items were discussed:
-The Licensee confirmed that the facility is meeting the requirements for multi-age care, and that care is provided only in the Licensed space in the basement of the home.
-Licensing recommends that although there is a fenced in area in the backyard for children to play, the Licensee cleans up the other areas of the yard from tools, waste, etc.
-Licensing recommends more adequate ground cover is placed beneath the play structure in the outdoor play space.
-The Licensee confirmed that the trampoline in the front yard is not used by children in care.

The inspection findings were reviewed with the Licensee at the time of inspection and a copy of the inspection report and risk assessment were provided.
