Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act, Child Care Licensing Regulationand the applicable Director of Licensing Standards of Practice. All areas of the facility were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation (CORRECTED DURING INSPECTION): The families provide their child with lunches. The Licensing Officer observed one child's lunch in a thermos and another child's lunch in an insulated bag. The contents of the bag were not warm and their is the potential of a child getting ill from food not properly stored.
Corrective Action(s): Discussed with the Licensee the importance of keeping food warm/hot or cold to prevent spoilage. The Licensee placed the high risk foods in the fridge at the time of the inspection.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11220 - CCLR s.23(2) - A licensee must have first aid kits that are readily accessible to all employees, including while care is provided off the community care facility premises.
Observation: The Licensing Officer reviewed the facility's first aid kits; one for off site and the other for onsite. Upon review of the kits the Licensee is missing a number of items including an instant ice pack.
Corrective Action(s): The Licensing Officer provided the Licensee with a list of items to be included in their first aid kit. The Licensing Officer also discussed with the Licensee the importance of taking the first aid kit and children's emergency consent cards with them whenever they leave the facility. The Licensee must update their first aid kits prior to taking children off site.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: There is an individual onsite who is working with the children. Upon review of the individual's file there is no evidence of references.
Corrective Action(s): Ensure all staff/volunteers have the 3 references (checked by the Licensee) prior to working with the children.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: The Licensing Officer reviewed a staff file and noted that the file did not contain a copy of the individual's resume or work history.

Corrective Action(s): Prior to staff/volunteers working with the children all applicable documentation must be onsite.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Upon review of staffs files the Licensing Officer noted that one individual does not have their immunization status on file.

Corrective Action(s): Ensure all information required by the legislation is onsite prior to a staff/volunteer working with the children. The Licensing Officer left a sample form for the Licensee regarding this requirement.

STAFFING: 12190 - CCLR s.22(2)(b) - A licensee must ensure that each employee (b) practices implementing the fire drill system at least once each month.
Observation: The Licensing Officer reviewed the book where the Licensee records their monthly fire drills. There was an entry for Jan, Feb and March 2018 but none for the remainder of 2018. The Licensee recorded a fire drill for January 2019.

Corrective Action(s): The Licensee must practice and record monthly fire drills.

STAFFING: 12200 - CCLR s.22(2)(c) - A licensee must ensure that each employee (c) practices implementing the emergency plan at least once each year.
Observation: In discussion with and upon review of the facility's documentation the Licensee was unable to show the Licensing Officer a record that the annual emergency drill was conducted for 2018.

Corrective Action(s): The Licensee is required to practice a yearly emergency drill. The staff of the facility must take all emergency equipment (please review annually to ensure there is enough food, water, emergency supplies for all the children and staff for a period of at least 3 days) with them during this drill.

STAFFING: 12430 - CCLR s.56(1)(b) - A licensee must keep current records of each of the following: (b) for each employee, the records required under section 19 (1) [character and skill requirements].
Observation: Upon review of the staff's criminal record clearance letter the Licensing Officer noted the clearance letters expired in November 2018.

Corrective Action(s): Criminal record clearance letters are valid for a period of 5 years and then they need to be renewed. The Licensing Officer provided the Licensee with the online code to apply online to renew the staffs criminal record checks conducted by the Criminal Records Review Agency. The Licensee must apply to the Criminal Records Review Agency as soon as possible as it may take a few weeks to process an application.

POLICIES AND PROCEDURES: 13060 - CCLR s.56(1)(d) - A licensee must keep current records of each of the following: (d) written policies and procedures that are intended to guide employees in the care and supervision of children.
Observation: Noted on the previous facility inspection report #KSEY-AWVNJL, dated March 15, 2018 the Licensee was found in violation of not having an active play or a screen time policy. During today's inspection the Licensee has not completed this requirement. The Licensing Officer provided the Licensee with a copy of the Director of Licensing Standards of Practice Active Play Policy for their reference. This is a repeat violation.
Corrective Action(s): The Licensee must develop these two policies and share them with the existing families and any future families.

RECORDS AND REPORTING: 19320 - CCLR s.59(a) - In respect of a record referred to in this Division, a licensee must (a) keep in a single place at the community care facility the records referred to in sections 56 to 58.
Observation: During today's inspection the Licensing Officer asked the Licensee to view their policies as the noted on the previous inspection report #KSEY-AWVNJL that the Licensee was reminded to share their policies with families or post them. This information was not posted nor has the Licensee shared the information with the families.

The Licensing Officer asked to review the facility's policies and the Licensee was unable to locate them. The Licensee produced resources from a course on Introduction to Family Child Care but nothing specific for their child care facility.

The Licensee is unsure where these documents are during today's inspection.
Corrective Action(s): The Licensee will locate the facilities policies (care and supervision, guidance, active play and screen time) to share with families and licensing.

Comments

At the inspection dated February 6, 2019 there were 2 children and 2 staff present. At this inspection the Licensing Officer identified 10 violation which are noted above Actions required by the Licensee are included in this report. A follow up inspection will be required.

As part of this routine inspection a Facility Risk Assessment Tool is completed and a copy is provided.

Education and recommendations:
continuous active supervision;
notification of reportable incidents;
lead in drinking water;
mandatory inspections to assess applications for temporary placements or retentions and exemptions;
promotion of active play.
