Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). All care categories were inspected for compliance.

Observed Violations
STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Three staff files were reviewed. One staff file did not have evidence of a valid criminal record check.During the inspection, ECE staff called the manager, who informed that the CRC application had been submitted but the results are still pending. Staff file did not have a copy of CRC application.
Corrective Action(s): Please ensure all staff persons have a criminal record check through the criminal records review branch in Victoria before they start their employment.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Three staff files were reviewed. One staff file was missing character references. During the inspection ECE staff called the manager who said that the references had been verified but not documented.
Corrective Action(s): Please ensure all references are verified and documentated before a staff person starts to work at the facility.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Three staff files were reviewed. Immunization status was not obtained for one staff.
Corrective Action(s): Plesae ensure there is evidence in staff file that staff has complied with the Province's immunization program.

Comments

At the inspection dated March 25, 2024 there were twenty two children, three staff and three ECE practicum students present. At this inspection the above noted contravention was identified. Licensing conducted a walk-through of the entire facility. The Manager will take action to bring the facility into compliance and provide a written response to the Licensing Officer by March 28, 2024 stating how the identified contraventions will be addressed to ensure year-round compliance. The Licensing Officer will review the response. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.

The following were discussed with the ECE staff:
Walls in the multi age room at children level are showing signs of wear and tear with visible peeling paint. Discussed having plan to address this.
The inspection report was written on-site and details were reviewed with the ECE staff prior to writing the report. A copy of the follow up to routine inspection report and risk assessment will be emailed to the manager.
