Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSOP). Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.

The following areas were reviewed:

· Hygiene and Communicable Disease Control
· Medication
· Program
· Records and Reporting

As part of the routine inspection a Facility Risk Assessment Tool is completed and a copy is provided. The Risk Assessment includes non-compliance identified during the routine inspection and a 3 year “historical” review of the facility’s compliance and operation.

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
CARE AND/OR SUPERVISION: 14030 - CCLR s.34(2)(b) - Without limiting subsection (1), a licensee must ensure that (b) the ratio of employees to children attending a community care facility is no less than that permitted in Schedule E.
Observation: On August the 22nd, Licensing identified that the staff to child ratios for the 30 months to School Age program was 1 ECE and 1 responsible adult for a group size of 13 children. Licensing informed that the staff to child ratios should have been 1 ECE and 1 ECEA at a minimum. Staff advised that the schedule was changed the morning of and that staff to child ratios are otherwise maintained.
Corrective Action(s): Please ensure a ratio of 1 ECE and 1 ECEA in the 3-5 program. In the event of an absent staff member, employee qualifications can be applied as per section 37 (3) of the CCLR.

CARE AND/OR SUPERVISION: 14180 - CCLR s.48(7) - A licensee must ensure that food and drink are not used as a form of reward or punishment for children.
Observation: Licensing reviewed the minor incident log book from the School Age program and 5 documentation logs indicated that children were not given snack for a particular time of the day. A staff member confirmed that it is practice to take children's food away following 3 attempts to stop a child from "goofing" around. Licensing informed that this is considered using food as a form of punishment as the disciplinary action is to take the food away. Licensing is requesting a written response indicating measures taken to comply with this section of the legislation.
Corrective Action(s): Please ensure staff do not use food as a form of punishment.

RECORDS AND REPORTING: 19320 - CCLR s.59(a) - In respect of a record referred to in this Division, a licensee must (a) keep in a single place at the community care facility the records referred to in sections 56 to 58.
Observation: Two staff members, from other sites, were working at this location at the time of the inspection. The documents referred to in section 19 (1) of the CCLR were kept at a different location for both staff members and Licensing was able to identify a checklist demonstrating compliance with section 19(1) for only one of the two staff members.
Corrective Action(s): Please ensure evidence of compliance with the documents referred to in Division 4 of the CCLR.

A follow-up inspection is required as Licensing was unable to observed the preschool program or review children's files for the preschool program.
