Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DoLSoP). All care categories were inspected for compliance.

Observed Violations
STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: During the inspection, two staff files were reviewed and one staff had only one reference letter. One more reference letter is needed for this employee. Education was provided regarding checking the references of all staff employed at the facility.
Corrective Action(s): Please ensure all staff files are complete.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: During the inspection, two staff files were reviewed and one staff was missing a record of immunization.
Corrective Action(s): Please ensure all staff files are complete.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: During the inspection, two staff files were reviewed and one staff was missing the ECE certificate validation.
Corrective Action(s): Please ensure all staff files are complete.

STAFFING: 12160 - CCLR s.20(1) - The licensee must not permit a person over the age of 12 to be ordinarily present on the premises of a community care facility while children are present, unless the person is of good character and the licensee has obtained a criminal record check for that person.
Observation: During the inspection it was noted that a person ordinarily present at the facility had an expired CRC (Expiration date April 03, 2022).
Corrective Action(s): Please ensure that all persons ordinarily present at the facility have a current and valid CRC.

HYGIENE AND COMMUNICABLE DISEASE: 15030 - CCLR s.46(1) - A licensee must establish a program to instruct children in, and to practise the rules of, health and hygiene.
Observation: During the inspection the licensing officer observed children getting up from naptime and sitting down at the snack table. Licensing officer did not observe the children washing their hands before eating snack. Manager stated that they use one time wet wipes to clean the children's hands. Manager stated that children have their hands washed when they return from outside and after they have their diapers changed.
Corrective Action(s): Please ensure children practice the rules of health and hygiene by using soap and water and individual hand towels for drying hands.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: During the inspection of the daily attendance records, it was noted that on several days during the month of June the children were not signed out. Manager stated that the staff sign the children in and out and that at the end of the day sometimes she forgets to sign them out. This is a repeat contravention and it was noted on Inspection #SSAU-C4BSHV from June 25, 2021.
Corrective Action(s): Please ensure an accurate record of the children's attendance is kept on a daily basis.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: During the inspection, seven (7) children's files were reviewed and two (2) children's files were missing the name and phone number of an emergency contact person.
Corrective Action(s): Please ensure all children's files are complete.

Comments

At the inspection dated June 28, 2022 there were 7 children and 2 staff present. At this inspection the above noted contraventions were identified. Actions required by the licensee and actions required the LO included here. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.

The following education/recommendations were provided:
· Promoting Active Play in the program
· Practicing hand washing and promoting health and hygiene for children and staff
· Verification of staff's ECE certificates and their references before hiring
· Active Supervision
· Lead in the Water
