Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). All care categories were inspected for compliance.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: The name of the facility manager is not posted.
Corrective Action(s): Please ensure the name of the facility manager is posted.

LICENSING: 10070 - CCLR s.11(4) - A licensee must display in a prominent place in the community care facility the certificate, or a copy of the certificate, of any educator or assistant employed to work in the community care facility.
Observation: Certificates for two educators were not posted in the facility.
Corrective Action(s): Please ensure certificates are posted for all program educators and assistants.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: CCFL observed a water table, two standing fans and staff belongings outside of the entrance to the nap room. These objects may make evacuating children out of the nap room in an emergency difficult.
Corrective Action(s): Please ensure that the entrance to the nap room is kept clear.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: The zipper on a large couch cushion in a small play room is broken exposing the interior of the cushion, A couch in the main play area is in need of cleaning. The lid and foot pedal of a garbage can in the bathroom are broken. There is a hole in the door to the nap room caused by the door closing onto a shelf.
Corrective Action(s): Please ensure all areas of the facility are clean and in good repair.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11110 - CCLR s.15(2)(b) - A licensee must ensure that each piece of furniture or equipment for sleeping (b) is clean and comfortable.
Observation (CORRECTED DURING INSPECTION): CCFL observed a sheet in a child's crib that was in need of cleaning.
Corrective Action(s): Staff placed a clean sheet in the crib during the inspection.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: CCFL observed the following:
A bleach bottle accessible to children in the bathroom.
Extension cord from a fan accessible to children in the nap room.
Two nails on stair rails in the outdoor play area.
Corrective Action(s): Please ensure children do not have access to any hazardous objects.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: The staff screening record needs to be updated and evidence of a criminal record check was not available for two staff.
Corrective Action(s): Please ensure a current staff screening record is available.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: The staff screening list needs updating and was missing evidence of references for two staff.
Corrective Action(s): Please ensure a current staff screening list is available.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: The staff screening record needs updating and was missing evidence of a resume for two staff.
Corrective Action(s): Please ensure a current staff screening record is available.

STAFFING: 12070 - CCLR s.19(1)(d) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (d) copies of any diplomas, certificates or other evidence of the person's training and skills.
Observation: The staff screening record needs to be updated and evidence of staff qualifications were not available for two staff.
Corrective Action(s): Please ensure a current staff screening record is available

STAFFING: 12190 - CCLR s.22(2)(b) - A licensee must ensure that each employee (b) practices implementing the fire drill system at least once each month.
Observation: A fire drill had not been practiced in the month of August 2023.
Corrective Action(s): Please ensure a fire drill is practiced each month.

STAFFING: 12370 - CCLR s.37(3)(b) - Despite the employee qualifications required by Column 4 of the table in section 1 of Schedule E [group sizes and employee to children ratios], a licensee must replace an absent employee described in Column 1 of the following table who is absent (b) for 30 consecutive days or more with a person described in Column 3 opposite that employee and the row in Column 2 labelled as "≥ 30 days".
Observation: Staff stated that an ECE Assistant has been working in place of an ECE for more than 30 days.
Corrective Action(s): If an ECE is absent for more than 30 days they must be replaced with a staff person with an ECE Certificate.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must: (b) have an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: The inspection decal on the fire extinguisher expired on August 25, 2023.
Corrective Action(s): Please ensure fire extinguishers have a current inspection decal.

Comments

Summary of Inspection
At the inspection dated September 12, 2023 there were 12 children and three staff present. At this inspection the above noted contraventions were identified. The Licensee will take action to bring the facility into compliance and provide a written response to the Licensing Officer. The Licensing Officer will review the response. As part of this routine inspection, a facility risk assessment tool is completed and a copy is provided. This report was reviewed with the manager and written off site. A copy of this report will be emailed to the manager.
The following were discussed:
Ensuring all products wiht a DIN have not passed their expiry date.
Staffing Exemptions.
