Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All care categories were inspected for compliance.

Licensing visited the facility on April 9th from 10:00 a.m. to 11:30 a.m. then returned to gather more information regarding the children’s registration forms from 3:00 p.m. to 3:30 p.m.

Licensing visited the facility on April 11th to gather more information regarding a child’s registration form. This information was not available.

Licensing visited the facility on April 15th to review the routine inspection report with the Director.

Observed Violations
CARE AND/OR SUPERVISION: 14020 - CCLR s.34(2)(a) - Without limiting subsection (1), a licensee must ensure that (a) children attending a community care facility are divided into groups, with each group having no more children than that permitted in Schedule E.
Observation: On April 9th, there were 9 children in care and the facility is licensed to provide care to a maximum of 8 children at one time. It was confirmed that this occurred on more than one occasion.
Corrective Action(s): The max capacity of 8 children cannot be exceeded.

RECORDS AND REPORTING: 19060 - CCLR s.57(1)(a)(b)(c) - A licensee must keep current records for each child showing (a) the information set out in subsection (2), (b) if applicable, the information and agreements set out in subsections (2.1) and (2.2), and (c) the consents referred to in subsection (3).
Observation: One child who was in care did not have a registration from so there was no record of the information set out in section 57 of the child care licensing regulation (CCLR).
Corrective Action(s): Please ensure the information set out in section 57 of the CCLR is obtained for the child prior to their attendance at this center.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: On April 9th, there were 9 children in attendance and the attendance record showed that there were 7 children in care. It was also confirmed that on multiple occasions, the attendance record did not accurately reflect the numbers of kids in care.

This is considered a repeat contravention as discrepancies with the attendance record was observed in the past routine inspections.
Corrective Action(s): The Director advised that they will ensure that children are signed in.

RECORDS AND REPORTING: 19340 - CCLR s.59(c) - In respect of a record referred to in this Division, a licensee must (c) produce records, on demand, to the medical health officer.
Observation: The Manager was not able to locate the facilities policy and procedures.
Corrective Action(s): The Director advised that they will bring a copy into the facility.

Comments

When Licensing arrived for the inspection on April 9th, there were 3 adults and 10 children getting ready to go outside. One individual left with a child and they were identified as a parent visiting the center.

The above noted contraventions were identified. Based on the routine inspection, Licensing will be arranging a meeting with the Director.

The information contained in the report was discussed with the Director and the report and risk assessment were written on-site. Licensing advised that copies of the report and risk assessment would be emailed to the facility.
