Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DoLSoP). All care categories were inspected for compliance.

Contraventions

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Licensing observed the following;
- There is a swing set that has been installed in the outdoor play area. The swing set is very close to the back wooden fence. Potential for a child to hit their body against the wooden fence if they were swinging on the swings.
- There isn't sufficient resilient surfacing under one of the swings. Licensing provided education on the importance having resilient surfacing under the swing set to prevent a child from injuring themselves.
- The bedding on the children's sleeping mats are touching. Potential for cross contamination and spreading of germs. Licensing provided education on ensuring children's bedding is not touching especially during a pandemic.
Corrective Action(s): August 31, 2021.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: Licensing observed the following that are accessible to children in care;
- An open soiled diaper in one corner of the covered cement outdoor play area.
- A diaper rash cream on the diaper change table located in the main play area.
- A corner part of an outside drainage in the outdoor play area. There are sharp edges on the drainage part.
Corrective Action(s): Ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.

CARE AND/OR SUPERVISION: 14060 - CCLR s.39(1) - A licensee must ensure that children are supervised at all times by a person who is an educator, an assistant or a responsible adult.
Observation: Licensing observed the following;
- The gate to enter into the facility premise was locked. After speaking with an individual, Licensing was informed that they would open the gate for Licensing. After 5 minutes the staff from the facility came out to open the gate for Licensing, leaving the seven children in care unsupervised. Licenisng observed that there were children's snacks on the table. Licensing provided education on the importance of ensuring that children are supervised at all times especially if they are eating.
- While Licensing was speaking to the Manager, Licensing observed two children screaming and fighting for a couple of minutes. The staff who was supervising the children was in another room on the phone. Licensing suggested, to the Manager, having a discussion with the staff regarding active supervision and phone usage while children are in care.
Licensing informed the Manager that if the gate is going to remain locked then a system needs to be in place where the children will not be left alone so that the staff can open the gate.
Corrective Action(s): Ensure that children are supervised at all times.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Upon a review of the attendance records for the month of August 2021, Licensing observed the following;
- Three days that several children were not signed out.
- Upon discussion with the staff and Manager there was a child that attended the facility today (Aug.23/21) and had left at 2:30 PM. The child was not signed in or out for the day.
Education provided on the importance of ensuring that attendance records are accurate.
This is a continuous repeated contravention.
Corrective Action(s): Ensure that attendance records are accurate on a daily basis.

RECORDS AND REPORTING: 19190 - CCLR s.57(3)(a) - A licensee must have in writing from a parent, and maintain at the community care facility, consent (a) to call a medical practitioner or ambulance in case of accident or illness if the parent cannot immediately be reached.
Observation: Upon a random review of six children's records, Licensing observed one child missing consent to call a medical practitioner or ambulance in the event of an accident or illness if the parent cannot immediately be reached..
Corrective Action(s): Ensure that children's records are complete prior to the child attending the community care facility.

Comments

Summary of Inspection
At the routine inspection conducted on August 23, 2021, there were seven children, and one staff present. The Manager arrived shortly after Licensing started the inspection. At this inspection the above noted contraventions were identified. The Licensee is required to correct all identified non-compliances by the dates indicated above in the violations section.A written response is to be provided to Licensing on the date specified for Licensing to review that appropriate corrective action has been taken to address all identified non-compliances. As part of this Routine Inspection a Facility Risk Assessment Tool is completed.
The following education/recommendations were provided:
Emergency cards; if using for off-site ensure all the children's emergency cards are in place.
Outdoor time
Active supervision
Explained what would be sufficient for indoor active play if weather does not permit children to go outside.
Updating children's photos
The contents of the inspection report was reviewed with the Manager at the time of the inspection. This report was written off site ( .75 hrs ) due to Covid-19 to help promote health and hygiene. A copy of this report and the risk assessment was emailed to the facility.
