Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). All areas of the facility were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: During inspection Licensing observed:
-·Two baskets stored on top of a shelf in the play room. These items were unstable and may pose as a risk of falling over children.
-Garden hose was stored on the path leading to outdoor play area. Licensing was concerned that it posed as a climbing,tripping and a strangulation hazard. Staff corrected this during inspection. This is repeat non compliance and was noted on routine inspection #SMIA-C95RMQ dated 26 Nov 2021.
-Toilet seat cover was cracked. Manager said that this happened yesterday and it will be replaced this week.
-Cloth canopy on the outdoor play climber has mildew on it and is torn in several places making it accessible to children. Manager said she is aware of this and a family member had measured it yesterday to fix it.
- Wooden deck platform used for play has visible sections of rotting wooden showing the surface underneath it and edges of some of the wooden planks are showing signs of wear and tear.
Corrective Action(s): A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: Two staff employed as an Early Childhood Educator Assistant did not have their certificate verified by the Early Childhood Educator Registry. This is repeat non compliance and was noted on routine inspection #SMIA-C95RMQ dated 26 Nov 2021.

Corrective Action(s): Please ensure that any staff that hold ECE/ECEA certificate issued by the ECE Registry is verified through ECE registry.

HYGIENE AND COMMUNICABLE DISEASE: 15010 - CCLR s.14(4)(a) - A licensee, other than a licensee who provides a care program described as either Preschool (30 Months to School Age) or Group Child Care (School Age), must have in a community care facility a sturdy surface for changing diapers, located outside the food preparation area, next to (a) a covered container for soiled clothing.
Observation (CORRECTED DURING INSPECTION): During inspection licensing did not observe a covered container for soiled diapers in the area where the diapering area is located. Manager explained that soiled diapers are placed in plastic bags and disposed in an uncovered kitchen garbage container. Education was provided to have a covered container for soiled diapers. Manager corrected this during inspection.
Corrective Action(s): : Please ensure that a covered container for soiled diapers is available at all times next to the diapering change area.

Comments

At the inspection dated September 28, 2022 there were six children,one staff and the manager present. At this inspection the above noted contraventions were identified. The Manager will take action to bring the facility into compliance and provide a written response to the Licensing Officer by September 29, 2022. The Licensing Officer will review the response. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.

The following were discussed with the Manager:

Maintaining log of minor accidents, illnesses and unexpected events involving children, that do not require medical attention and are not reportable incidents described in Schedule H.
Maintaining staff and children records
Schedule E staffing requirements for this service type
Fire extinguisher to be serviced by October 13, 2022
White gate in the front yard opens into the neighbours yard and is used by families with strollers. Latch of the white gate to be inaccessible to children.
Manager is considering replacing carpets as some carpet stains are not coming off even after several attempts of cleaning
Use of sleeping equipment (playpen) used for children must meet manufacturer’s guidelines
The inspection report was written on-site and details were reviewed with the Manager prior to writing the report. A copy of the routine inspection report and risk assessment is provided to the manager at this inspection.
