Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: Licensing observed the managers name not posted.
Corrective Action(s): Please ensure the name of the manager is displayed in a prominent place.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Licensing observed the following in the outdoor play area:
- Tires with rust on it
- A large rake accessible to the children
- A red child size couch with wear and tear
- Four child size chairs with rust

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation (CORRECTED DURING INSPECTION): Licensing observed a medication box with various medications in there accessible to the children.
Corrective Action(s): Please ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: A selection of staff files were reviewed. Out of the five files reviewed, two files contained criminal record checks addressed to another facility. Three files contained expired criminal record checks.
Corrective Action(s): Please ensure persons hired in a community care facility have a valid criminal record check on file.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: A selection of staff files were reviewed. Out of the five files reviewed, two files did not have character references.
Corrective Action(s): Please ensure persons hired in a community care facility have character references on file.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: A selection of staff files were reviewed. Out of the five files reviewed, two files contained no resume.
Corrective Action(s): Please ensure a record of the person's work is on file.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: A selection of staff files were reviewed. Out of the five files reviewed, two files contained no immunization status.
Corrective Action(s): Please ensure persons hired in a community care facility have an immunization status on file.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: A selection of staff files were reviewed. Out of the five files reviewed, all five files did not contain a validation.
Corrective Action(s): Please ensure any staff with an educator or assistant certificate, must be verified using a system established and maintained by the director of the early childhood educator registry.

STAFFING: 12200 - CCLR s.22(2)(c) - A licensee must ensure that each employee (c) practices implementing the emergency plan at least once each year.
Observation: There is no indication of an emergency plan conducted within this year. The licensee stated they do practice the emergency drill however, have not recorded this. In addition, the licensee stated they do not take the emergency supplies with them.
Corrective Action(s): Please ensure each employee practices implementing the emergency plan at least once a year.

RECORDS AND REPORTING: 19030 - CCLR s.55(2)(a) - A licensee must notify the medical health officer within 24 hours after (a) a child is involved in, or may have been involved in, a reportable incident described in Schedule H while under the care or supervision of the licensee.
Observation: Licensing noted in the log book an incident that should have been reported to licensing from July 2019.
Corrective Action(s): Please ensure a medical health officer is notified within 24 hours after a child is involved in or may have been involved in a reportable incident.

RECORDS AND REPORTING: 19220 - CCLR s.58(1)(b) - A licensee must keep, for each child requiring extra support, a current care plan showing the following information: (b) the courses of action recommended by health care professionals to address the needs of the child requiring extra support.
Observation: Licensing observed no care plan in place for one child. The epi-pens prescribed to this child were also expired.
Corrective Action(s): Please ensure a current care plan showing the courses of action recommended by health care professionals are on file.

Comments

At the inspection dated November 18, 2019 there were 21 children and 5 adults present. At this inspection the above noted contraventions were identified.
Action required by the licensee includes providing a written response by November 25, 2019.
As part of the routine inspection a Facility Risk Assessment Tool is completed and a copy is provided. The Risk Assessment includes non-compliance identified during the routine inspection and a 3 year “historical” review of the facility’s compliance and operation.
The following discussions were provided:
- During a discussion with the licensee it was noted that the emergency supplies were too heavy for any staff to take out in the event of an emergency. Licensing suggested other storage boxes with wheels that could be used to help.
- Licensing observed the fence in the outdoor play area showing signs of wear. The licensee is aware that the fence requires replacing and is in the process of replacing it by the summer.
