Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: One Staff file was not available for review and a checklist not maintained therefore a CRC clearance could not be reviewed.
Corrective Action(s): please ensure a system is in place to capture staff screening
Date to be Corrected: March 6, 2019

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: One staff file was not available for review therefore references could not be audited.
Corrective Action(s): please ensure a system is developed in capture staff documentation

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: One Staff file was unavailable for review documentation including a resume was not maintained.
Corrective Action(s): ensure a system is in place to ensure staff screening / documentation is in place.

STAFFING: 12070 - CCLR s.19(1)(d) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (d) copies of any diplomas, certificates or other evidence of the person's training and skills.
Observation: Staffing exemption in place for 1 staff who works in the preschool , staffing plan carries the attached expiry date of Jan 1, 2019. A Certificate of ECE or ECA was not located within the staff file , manager unaware of the expiry date and if the individual had received the certificate from the registry.
Corrective Action(s): Ensure staff hold the required Certification for the position held.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Immunization status was unavailable for review as the staff file was not maintained on site
Corrective Action(s): ensure a system is in place to capture staff screening including immunization status.

Comments

Summary of Inspection- At the inspection dated March 1, 2019 there were 16 children and 2 staff present. At this inspection the above noted contraventions were identified.Licensee to provide a written response and include plan for decrease of office space and stored items which have in turn decreased the amount of useable floor space.Measurements taken usable floor space meets for 18 children. Licensing to confirm receipt of written response by email. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.
