Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSOP). All areas of the facility were inspected for compliance.

Contraventions

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: Licensing observed the following inside the care facility;
- Paint on the wall in several areas of the facility is chipped.
- Walls in several areas of the facility with crayon drawings and stains on them.
- Tap in the bathroom sink is broken.
- Closet in one of the play area is broken and off its hinge at the top.

Licensing observed the following In the outdoor area;
- Small car with cracked handles.
- One tricycle with rust on its handles.
- A pedal missing from a tricycle.
- Another tricycle with several cracks on it's seat.

Corrective Action(s): Please ensure that the furniture, fixtures and equipment within the care facility are clean and in good repair.
Date to be Corrected: July 5, 2019.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation (CORRECTED DURING INSPECTION): Licensing observed the following that is accessible to children in care;
- An unlocked drawer in the bathroom with nail polisher remover solution bottle, tube of hair gel, eye make-up remover wipes and 2 nail polishes.
- An unlocked cupboard in the bathroom with several plastic bags, bathroom cleaning solution spray bottle, air freshener aerosol spray bottle.
- Another unlocked drawer in the bathroom with 4 tubes of diaper rash creams.
- An unlocked drawer in the kitchen area with a lavender essential oil bottle and a perfume spray bottle.
- Blind cord hanging in one of the play areas..
Corrective Action(s): Please ensure that children in care do not have access to any hazardous objects or substances.
Date to be Corrected: June 28, 2019.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Upon review of 2 staff files Licensing observed 1 staff without references. Upon discussion with the manager Licensing was informed that references were provided. However, there is no evidence for Licensing to review that the references were checked.
Corrective Action(s): Please ensure that staff files are complete prior to the staff working at the care facility.
Date to be Corrected: July 5, 2019.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Upon review of 2 staff files, Licensing observed one staff's file without immunization status.
Corrective Action(s): Please ensure that staff files are complete prior to the staff working at the care facility.
Date to be Corrected: July 5, 2019.

STAFFING: 12160 - CCLR s.20(1) - The licensee must not permit a person over the age of 12 to be ordinarily present on the premises of a community care facility while children are present, unless the person is of good character and the licensee has obtained a criminal record check for that person.
Observation: Licensing observed that there is one individual who is ordinarily present on the premises of the care facility, over the age of 12, that has not had a criminal record check done and another individual who is ordinarily present on the premises, over the age of 12, whose criminal record check is not site specific.
Corrective Action(s): Please ensure that any individuals over the age of 12 that are ordinarily present on the premises of the care facility while children are in care have had a cleared criminal record check done.

STAFFING: 12190 - CCLR s.22(2)(b) - A licensee must ensure that each employee (b) practices implementing the fire drill system at least once each month.
Observation: Upon review of the fire drill for the year 2019 Licensing observed that a fire drill was not implemented for the month of June.
Corrective Action(s): Please ensure that a fire drill system is practiced at least once a month.
Date to be Corrected: July 5, 2019.

STAFFING: 12210 - CCLR s.23(1)(a) - A licensee must ensure that children have at all times immediate access to an employee who (a) holds a valid first aid and CPR certificate, provided on completion of a course that meets the requirements of Schedule C.
Observation: Upon discussion with the manager, Licensing observed that there is a individual who picks up children from a school and walks with them to the care facility. This individual does not hold a valid first aid and CPR certificate.
Corrective Action(s): Please ensure that children have at all times immediate access to an employee who holds a valid first aid and CPR certificate.
Date to be Corrected: July 2, 2019.

POLICIES AND PROCEDURES: 13010 - CCLR s.22(1)(a) - A licensee must have all of the following: (a) emergency exits and a fire drill system approved by a local assistant within the meaning of the Fire Services Act.
Observation: Licensing observed that the fire extinguisher was due for servicing for June 19, 2019 but, has not been serviced.
Corrective Action(s): Please ensure that a fire drill system has been approved by a local assistant within the meaning of the Fire Services Act.
Date to be Corrected: July 5, 2019.

CARE AND/OR SUPERVISION: 14060 - CCLR s.39(1) - A licensee must ensure that children are supervised at all times by a person who is an educator, an assistant or a responsible adult.
Observation: Licensing observed that the manager came inside from outdoor play time with 7 children. After about 5 minutes another child knocked on the door and once the manager opened the door the child came inside. This child had been left outside in the outdoor play area without the manager's knowledge.
Corrective Action(s): Please ensure that children are supervised at all times while in care by an educator, an assistant or a responsible adult.
Date to be Corrected: June 28, 2019.

HYGIENE AND COMMUNICABLE DISEASE: 15030 - CCLR s.46(1) - A licensee must establish a program to instruct children in, and to practise the rules of, health and hygiene.
Observation: Licensing observed the following;
- The tables where children had lunch had not been sanitized.
-There was no sanitization bottle available. The manager informed Licensing that they have a bleach and water solution bottle but could not find it to show Licensing.
- There is one towel in the bathroom that all the children use to dry their hands throughout the day. The manager removed the towel and put separate paper towels for children to dry their hands.
- The children's blankets are stored on top of each other in a closet shelf in the nap room.

Corrective Action(s): Please ensure that a program is established in practicing and guiding children in the rules of health and hygiene.
Date to be Corrected: July 2, 2019.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Upon review of 6 days of the attendance records for the month of June Licensing observed the following;
- 1 day two children time of departure was not indicated.
- 1 day a child was not identified as absent.
Corrective Action(s): Please ensure that attendance records are accurate on a daily basis.
Date to be Corrected: June 28, 2019.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: Upon review of 4 out of 11 children's records Licensing observed one child's record without a medical practitioner's name and telephone number.
Corrective Action(s): Please ensure that all children's records are complete prior to the children attending the facility.

Comments

At the routine inspection conducted today, June 28, 2019, there were 8 children and 2 staff present. At this inspection the above noted contraventions were identified. The Licensee is required to correct all identified non-compliances by the dates indicated above in the violations section. A written response is to be provided to Licensing on the date specified for Licensing to review that appropriate corrective action has been taken to address all identified non-compliances. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.
The following education/recommendations were provided:
Supervision
Staff files; doctor's note no longer a requirement.
Emergency kit; checking expiry dates for food, can opener.
Medication storage in fridge.
Lead in water; flushing of water daily to ensure that there is no lead in the water.
Licensing informed the Licensee that when reporting any reportable incidents to get in direct contact with a Licensing officer. If the Licensee's Licensing officer is unavailable then to call the Duty Line at (604) 587-3936.
