Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DoLSOP). Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.
The following areas were reviewed: Licensing; Physical Facility; Staffing; Polices & Procedures; Care & Supervision; Hygiene and Communicable Disease Control; Medication; Nutrition and Food Services; Program; Records and Reporting
As part of the Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided. The Risk Assessment includes non-compliance identified during the routine inspection and a 3 year “historical” review of the facility’s compliance and operation.

Licensing would like to thank the staff and children of Brightstart Children's Academy (Bainbridge) for their time and assistance during today’s inspection.

Contraventions
Previous Inspection - Contraventions observed on FIR #KSEY-AEUQ2D have been corrected except for those noted on supplementary pages.
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11230 - CCLR s.47 - A licensee must ensure that any heated water accessible to children is heated to no more than 49° Celsius.
Observation: During inspection Licensing determined that the water temperature in the Infant Room, Handicapped washroom and Preschool/ Out of School Care rooms was 51C. which exceeds the maximum water temperature of 49C.

Staff in the Infant and Preschool rooms state that they monitor to ensure that children use both the hot and cold water when washing their hands.
Corrective Action(s): Ensure all water accessible to children does not exceed 49C.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: During inspection Licensing reviewed staff records and noted two staff persons are missing their immunization status.
Corrective Action(s): Ensure all required documentation is on site for all staff working at this site.

STAFFING: 12430 - CCLR s.56(1)(b) - A licensee must keep current records of each of the following: (b) for each employee, the records required under section 19 (1) [character and skill requirements].
Observation: During inspection Licensing reviewed staff records and noted one staff person has a Criminal Record Approval letter addressed to a different employer/ educational institution.
Corrective Action(s): Ensure Criminal Record Approval letters are addressed to the Licensee for all staff persons working at this site.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: During inspection Licensing randomly reviewed 10 children's records and noted one child is missing their medical insurance number, and one child is missing their immunization status.
Corrective Action(s): Ensure all required documentation is on site for children attending the facility

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: During inspection Licensing randomly reviewed 10 children's records and noted one child is missing the doctor/ medical clinic information.
Corrective Action(s): Ensure all required documentation is on site for all children attending the facility.

Comments

During inspection Licensing noted that the pea gravel in the outdoor play area is not evenly distributed by the climbers/ slides. Ensure staff monitor the pea gravel maintain the proper depth of resilient surfacing around the climber/ slide structures. Manager stated staff monitor this on a regular basis.

During inspection Licensing noted some garbage located in the pea gravel in the outdoor play areas, children had not yet gone out to use this area. Staff stated that they do a sweep of the yards before children go out to pick up any garbage located there.

During inspection Licensing reviewed the facility "Active Play and Screen Use Policy", Licensing noted that it is missing information regarding daily facilitated and un-facilitated play.

During inspection Licensing observed the following activities taking place:

- Infant Room: some children were in the gym area & on a walk in the community; some children were playing with dramatic play equipment.
- Toddler Room: some children were finishing snack, having a circle about letters & then in the gym area engaged in gross motor activities
- 3-5 Room: children were finishing snack, having a circle time and then in the outside play area
- Preschool Room: children were having snack, a circle time and then engaged in an art activity.

Licensing noted examples of child direct art on display throughout the facility.

Licensing observed staff interacting with children while they were engaged in activities as well as assisting with problem solving when necessary.

As the Out of School program was not operating during today's inspection, Licensing will review their program during a follow up inspection.
