Introduction

An unscheduled follow-up inspection to Routine Inspection # SMIA-C35TZN was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP).

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation (CORRECTED DURING INSPECTION): Licensing observed the following accessible to children in the nap room:
·Cloth curtain hung from a window frame
·Cell Phone on the nap mat
·Electric outlet located beside a nap mat had a cell phone charging cord plugged into it with no device charging on the other end of the cable.
Corrective Action(s): Please ensure healthy and safe environmnet is provided at all times while children are under the supervision of employees.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: Licensing observed the following accessible to children in the play room:
-Paint was peeling in several areas on the window sill exposing the drywall underneath. Manager stated that she is aware of this as children often use this area on the window sill to roll toy cars and was planning to fix it in the coming days.
Corrective Action(s): Please ensure facility is in good repair while children are in attendance.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: A criminal record check for one staff person was not in file. Manager and staff stated that criminal record check was applied through RCMP two months ago and they are still awaiting the results. Staff file had no evidence of the Criminal Record check application. The Manager was unaware that criminal record check needed to be completed through the Criminal Record Review Agency. Licensing provided information and education.
Corrective Action(s): Please ensure all staff persons have a criminal record check done through the criminal records review branch in Victoria. Staff must not be left alone with children until till the criminal record check is completed through the Criminal Record Review Agency.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: One staff file was reviewed and there was no work history in file. Manager stated that staff had emailed the work history upon hiring. Licensing was not able to review staff's work history during inpsection.
Corrective Action(s): Please ensure that all staff records are complete prior to the staff working at the facility.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: One staff file was reviewed and it did not have the immunization status for the staff.
Corrective Action(s): Please ensure that all staff records are complete prior to the staff working at the facility.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: One staff new certificate has not been validated. The Manager was not aware that new certificates need to be validated. Licensing provided education that whenever a certificate is issued it needs to be validated through the Early Childhood Educator Registry.
Corrective Action(s): Please ensure that all staff records are complete prior to the staff working at the care facility.

Comments

During inspection dated September 14, 2021 a practicum student accompanied the licensing officer for training purposes. There were three children and two staff present. At this inspection the above noted contraventions were identified. Licensing conducted a walk-through of the entire facility.
The Manager will take action to bring the facility into compliance and provide a written response to the Licensing Officer by September 17, 2021. The Licensing Officer will review the response.
The following were discussed with the manager:
· Maintaining staff records
· Placement of nap mats and play pens to minimize direct contact between each nap equipment
· Validation of ECE certificates

· Criminal Record Review Program (via email)

The follow up inspection report was written off-site – details were reviewed with the Manager prior to writing the report. A copy of the follow up inspection report sent to manager via email on September 15, 2021. Total time includes writing report in office.
