Introduction

An unscheduled follow up inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP).
The purpose of this inspection was to follow up on how contraventions have been addressed from routine investigation inspection # .

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
STAFFING: 12030 - CCALA s.7(1)(a) - A licensee must do all of the following: (a) employ at a community care facility only persons of good character who meet the standards for employees specified in the regulations.
Observation: It was observed that a staff member present does not have the following that is required:
-Criminal Record Check from the Criminal Records Review in Victoria
-character references
-resume
-documentation of training and skills
-immunization status
The Licensee did provide evidence that the staff does have first aid training and a criminal record check has been applied for at the end of May 2019 through the Criminal Records review board.
Corrective Action(s): Licensee must ensure that a person of good character who meets the standards for employees specified in the regulations is employed to work in the community care facility.

CARE AND/OR SUPERVISION: 14020 - CCLR s.34(2)(a) - Without limiting subsection (1), a licensee must ensure that (a) children attending a community care facility are divided into groups, with each group having no more children than that permitted in Schedule E.
Observation: It was observed that 13 children were playing in the front yard upon licensing's arrival. All children were 3 or over the age of three. The License held at this facility is for 8 children maximum.
Corrective Action(s): Please ensure that the facility has no more that the children listed in schedule E for your license. The Licensee was required to contact parents of 5 children during this inspection to ensure that these children were picked up in order to have no more than the maximum number of children attending.

RECORDS AND REPORTING: 19060 - CCLR s.57(1)(a)(b)(c) - A licensee must keep current records for each child showing (a) the information set out in subsection (2), (b) if applicable, the information and agreements set out in subsections (2.1) and (2.2), and (c) the consents referred to in subsection (3).
Observation: It was observed that one child was missing children's records to include the following: date of birth, care card (MSP) number, immunization status, date of enrolment name and phone number of medical practitioner, emergency contact, allergies, records of any person who is not permitted access to the child. The Licensee was able to provide the child's name, the parent's name and phone number and the child's photograph.
Corrective Action(s): Please ensure that current records are kept for each child as listed.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: It was observed that the daily attendance records were missing the names of 3 children today who were in attendance.
Corrective Action(s): Please ensure that all children attending the program are listed with time in and time out for each day and whether the child is present or absent.

Comments

Summary of Inspection
At the inspection dated July 4, 2019 there were 13 children and 2 staff present. This is 5 children over the number on the facility's license. All of the children in attendance were 3 or over the age of three. At this inspection the above noted contraventions were identified.
The contraventions from the previous 2 inspections regarding medications have been addressed.
Actions required by the Licensee:
Take corrective action by bringing facility into compliance
Provide a Compliance plan in writing to Licensing by July 5, 2019 by 8:15 am to address how you will maintain compliance with number of children in care.
Provide a health and safety plan in writing to Licensing by July 5, 2019 by 8:15 am to address how your staff will be working with the children until you come into compliance.
