Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Observed Violations
STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Licensing reviewed the staff file and observed that a criminal record check was expired.
Corrective Action(s): Ensure that the criminal record check is updated and included on file.

STAFFING: 12160 - CCLR s.20(1) - The licensee must not permit a person over the age of 12 to be ordinarily present on the premises of a community care facility while children are present, unless the person is of good character and the licensee has obtained a criminal record check for that person.
Observation: The criminal record check for a person over the age of 12 who is ordinarily present has expired.

This item is a repeat violation from routine inspection report #CGEE-BQ3M8R (28/May/2020).
Corrective Action(s): Ensure that the criminal record check is updated and included on file.

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation: Licensing observed that the monthly fire drills and annual emergency drills have not been recorded. The manager stated during the inspection that both drills have been practiced with the children regularly.
Corrective Action(s): Ensure that the monthly fire drills and annual emergency drills are recorded and on file at the facility.

RECORDS AND REPORTING: 19050 - CCLR s.56(1)(f) - A licensee must keep current records of each of the following: (f) a log of minor accidents, illnesses and unexpected events involving children, that did not require medical attention and were not reportable incidents described in Schedule H.
Observation: Upon discussing with the manager, the minor incident log bound book could not be found during the inspection.
Corrective Action(s): Ensure that a minor incident log bound book is readily available in the facility.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: Licensing reviewed children's files and observed that one child was missing their immunization status on file.

Corrective Action(s): Ensure that the immunization status is included on file.

Comments

· Licensing went on-site and attempted to complete a routine inspection on July 14th and Aug. 31st 2022. However, there was no response at the door during these times.

At the inspection dated Sept. 21, 2022 there were 4 children and themanager was on-site and assisted with the inspection. At this inspection, the above noted contraventions were identified. Actions required by the licensee includes a written response. The contraventions noted in this report were reviewed with the manager during the inspection.

As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.

The following education/recommendations/discussions were provided:
- Reportable Incident procedures, which is to be reported within 24 hours. Child care staff are asked to call their Licensing Officer to make the report. If the Licensing Officer is unavailable, please call the Duty Line Licensing Officer.
- Outdoor play area cleaning and maintenance procedures
- Continue to clean and sanitize the facility including toys and equipment
- Continue to check the expiry date of items in the emergency supplies kit
- Attendance sheet recording and procedures
- Procedure for trips, walks, outings etc.
- Remove all items with a DIN/NPN # in the first aid kit, as parent’s permission is required before using these items on children. Mild soap and water can be used to clean any minor cuts or scrapes.
