Introduction

An unscheduled inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DLSOP). All areas of the facility were inspected for compliance.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: Licensing noted the name of the Manager was not displayed in the facility.
Corrective Action(s): Ensure the name of the Manager is displayed in a prominent place in the community care facility.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: Licensing reviewed 5 staff files and noted 2 staff did not have a record of work history.
Corrective Action(s): Ensure a record of work history is obtained prior to employment.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Licensing reviewed 5 staff files and noted 1 staff was missing immunization status.
Corrective Action(s): Ensure evidence of immunization is obtained prior to employment.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation: Licensing reviewed 10 children’s records and noted 1 was missing date of enrolment.
Corrective Action(s): Ensure a record is kept for each child showing the date of the enrolment in the community care facility.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: Licensing reviewed 10 children’s records and noted 1 was missing the name and telephone number of a medical practitioner.
Corrective Action(s): Ensure a record is kept for each child showing the name and phone number of a medical practitioner.

RECORDS AND REPORTING: 19320 - CCLR s.59(a) - In respect of a record referred to in this Division, a licensee must (a) keep in a single place at the community care facility the records referred to in sections 56 to 58.
Observation: Licensing noted the following were unavailable for review during the inspection:
- Active Play and Screen Time policies
- Emergency drill practices
Corrective Action(s): Ensure records referred to in sections 56 to 58 are kept in a single place at the community care facility.

Comments

At this inspection, there were 17 children and 7 staff present. At this inspection, the above noted contraventions were identified.
The following was discussed with staff:
· Emergency management
· COVID-19 prevention strategies
· Outdoor play
· Toy/equipment storage

The Manager is to correct the contraventions by the dates indicated, and provide a written response to licensing.

As part of the routine inspection, a Facility Risk Assessment Tool was completed.

The inspection report was written off-site - all details were reviewed prior to writing the report. A copy of the inspection report and risk assessment will be e-mailed to the Manager.
