Introduction

A scheduled follow up inspection was conducted to routine inspection report #EGAU-BMDSBW, dated March 4, 2020.

Contraventions

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Licensing saw multiple areas within the main floor where gyproc and metal bracing is exposed making these areas non cleanable (porous) and unsafe for children. The areas included but are not limited to: main entry, kitchen, cubbies etc.

Corrective Action(s): These areas will need to be repaired and sealed (painted). The Licensee said she has applied with her strata corporation to have the work done and is awaiting a response. The Licensee is requested to submit a written plan of action, including time lines as to when the work will be finished, to the Licensing Officer by May 11, 2020.

CARE AND/OR SUPERVISION: 14080 - CCLR s.40(1) - Subject to subsections (2) and (3), a licensee must not provide care for more than 13 hours each day to each child.
Observation: The Licensee informed the Licensing Officer that there are children in care who attend more than 13 hours per day.

Corrective Action(s): Licensing discussed with the Licensee various ways to address this requirement including applying for an exemption.

CARE AND/OR SUPERVISION: 14360 - CCALA s.7(1)(b)(i) - A licensee must do all of the following: (b) operate the community care facility in a manner that will promote (i) the health, safety and dignity of persons in care,
Observation: In discussion with the Licensee it was determined that there is a child attending who is over 12 years of age. The Community Care and Assisted Living Act defines a child as "a person under the age of 13 years".
Corrective Action(s): Licensing discussed options as to how the Licensee could comply with this requirement including applying for a temporary retention.

Comments

At the inspection dated, April 28, 2020 the Licensee was expecting a child to attend however no children were in care during the time Licensing was present.

All previously coded items on the routine inspection report were satisfactorily addressed. During today's inspection Licensing identified additional contraventions that need to be corrected. These items are noted above and includes any action required by the Licensee.

Upon review of the Licensee's approved floor plans Licensing determined that the facility's maximum capacity included the following areas:
- room in the basement,
- main floor: kitchen, washroom, living room and an area off the kitchen.
During today's inspection the basement and living room are not being used to provide child care. The Licensee will need to reduce her capacity if she would like to remain using the current space to provide care or alternately reopen all the spaces as noted when the community care facility licence was issued. Please contact the writer to discuss the next steps.

Due to the current COVID 19 pandemic Licensing reviewed with the Licensee their cleaning and sanitizing procedures, and the implementation of their sick policy. Licensing provide to and reviewed with the Licensee the Fraser Health Resource Package for Childcare Facilities COVID 19 Prevention.

This inspection was reviewed with the Licensee at the time of the inspection. The report was written off site (time spent .5) and a copy was sent to the Licensee.
