Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). All care categories were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: Caulking on the back of the children's sink is showing signs of wear and tear and needs to be replaced.
Corrective Action(s): Please ensure the caulking on the back of the children's sink is in good repair.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: A criminal record check is not available for one staff. The manager said she has applied for this but the results have not been received.
Corrective Action(s): Please ensure a criminal record check is available for all staff.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: References were not available for one staff. This is repeat non-compliance and was noted on routine inspection #WBET-CF6RP7 dated June 7, 2022
Corrective Action(s): Please ensure a minimum of two references are available for all staff.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: A resume was not available for one staff. This is repeat non-compliance and was noted on routine inspection #WBET-CF6RP7 dated June 7, 2022
Corrective Action(s): Please ensure a resume is available for all staff.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Immunization status was not obtained for one staff person. The manager said she has requested this but has not received it yet.
Corrective Action(s): Please ensure immunization status is available for all staff. This is repeat non-compliance and was noted on routine inspection #WBET-CF6RP7 dated June 7, 2022.

RECORDS AND REPORTING: 19220 - CCLR s.58(1)(b) - A licensee must keep, for each child requiring extra support, a current care plan showing the following information: (b) the courses of action recommended by health care professionals to address the needs of the child requiring extra support.
Observation: One child's file does not include the what staff need to do if a child has a reaction to a food they are allergic to. The manager was able to describe what staff need to do if the child has a reaction.
Corrective Action(s): Please ensure written instructions letting staff know what to do if a child has an allergic reaction are in the child's file.

Comments

Summary of Inspection
At the inspection dated July 14, 2023 there were eight children and three staff present. At this inspection the above noted contraventions were identified. The Licensee will take action to bring the facility into compliance and provide a written response to the Licensing Officer. The Licensing Officer will review the response. As part of this routine inspection, a facility risk assessment tool is completed and a copy is provided. This report was reviewed with the manager and a copy of this report will be emailed to the manager.
