Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DoLSoP). All areas of the facility were inspected for compliance

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: Licensing observed that the bottom of one fence panel has detached from the fence with a nail sticking out.
Corrective Action(s): Please ensure fixtures within the facility are clean and in good repair while children are in attendance

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: Licensing observed under an unlocked cabinet where children have access to the following;
- Febreze aerosol spray
- Large bottle of bleach
Corrective Action(s): Please ensure that children do not have access to any object or subtance that may be hazardous to the health or safety of a child

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: Licensing reviewed 2 staff files and 1 staff was missing evidence of certificate validation
Corrective Action(s): Please ensure educators licences are verified by the system maintained by the early childhood registry

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must: (b) have an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: Licensing observed that fire extinguisher has not need serviced annually
Corrective Action(s): Please ensure that emergency plan sets our procedures to prepare for, mitigate, respond to and recover from any emergency.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation: Licensing reviewed 6 children's files and 3 files did not contain evidence of children's date of enrolment.
Corrective Action(s): Please ensure there is a record of date of enrolment in the community care facility.

RECORDS AND REPORTING: 19320 - CCLR s.59(a) - In respect of a record referred to in this Division, a licensee must (a) keep in a single place at the community care facility the records referred to in sections 56 to 58.
Observation: Licensing observed that 1 staff file was not available for viewing and off-site.
Corrective Action(s): Please ensure that staff files are accessible and contain all records referred to in Section 19(1).

Comments

At today’s inspection there were 7 children and 2 staff present including the manager.
At this inspection the above noted contraventions were identified. The Licensee will take action to bring the facility into compliance and provide a written response to the Licensing as indicated above. Licensing will review the response.
As part of this routine inspection, a facility risk assessment tool is completed. The risk assessment includes any non-compliance identified during the routine inspection, a 3 year ‘historical’ review of the facility’s compliance and operation. This is used to determine inspection frequency.
The contents of the inspection report were reviewed with the manager and written on-site. A copy of this report will be emailed to the manager and a paper copy will be mailed to the facility.
The following was discussed with the manager;
- Monitoring water temperature
- Monitoring supplies within first aid kit
- Maintenance of outdoor toys
- Sanitary practices for children’s bedding
- Reminder about first aid renewal
- Review of minor incident log
