Introduction

All care categories were inspected during an unscheduled routine inspection to assess compliance w/:
• the Community Care & Assisted Living Act
• the Child Care Licensing Regulation
• relevant Director of Licensing Standards of Practices

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: *Repeat violation from FIR #CGEE-BPLM2B (13/May/2020) & FIR #CGEE-C6734U (23/Aug/2021)*
A substitute employee lacked her CRC.
Corrective Action(s): This employee cannot work alone w/ children or assist w/ diapering/toileting until she has obtained her BC Ministry of Justice CRC.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: *Repeat violation from FIR #CGEE-BPLM2B (13/May/2020)*
A substitute employee lacked ≥ 2 references.
Corrective Action(s): All requirements of s. 19 are required by employee's 1st day of employment.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: A substitute employee lacked a record of her work history.
Corrective Action(s): All requirements of s. 19 are required by employees' 1st day of employment.

CARE AND/OR SUPERVISION: 14020 - CCLR s.34(2)(a) - Without limiting subsection (1), a licensee must ensure that (a) children attending a community care facility are divided into groups, with each group having no more children than that permitted in Schedule E.
Observation: > 8 children often combine to eat together in the largest (middle) room.
Corrective Action(s): MACC's maximum group size of ≤ 8 children can never be exceeded.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation (CORRECTED DURING INSPECTION): A child was not signed out upon departure.

RECORDS AND REPORTING: 19160 - CCLR s.57(2)(i) - A licensee must keep, for each child, a record showing the following information: (i) a photograph or digital image of the child, and other information that can be used to readily identify the child in an emergency.
Observation: Several children's files lacked a photograph or digital image.
Corrective Action(s): All requirements of s. 57 are required by children's 1st day of care.

6 violations were observed, in which 1 violation was corrected today & corrective action for the remaining 5 violations includes:
• obtaining employee documentation
• never exceeding the maximum group size
• obtaining children's photographs or digital image

The inspection was reviewed w/ the manager; however, this report & the risk assessment were completed offsite & emailed to the manager.
