Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DoLSoP). All care categories were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Licensing observed the following;
- A dirty mop and another dirty mop bottom in the covered cement outdoor area. The Manager informed Licensing that the dirty mop bottom was supposed to be thrown away and the dirty mop was put outside to dry. Licensing provided education that once children are outside it needs to be removed so children do not have access to them.
- Licensing observed the emergency door was wide open. The door leads into the Manager's private residence front door entrance area and the rest of the residence.
Corrective Action(s): Ensure that a healthy and safe environment is provided at all times while children are in care.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: Licensing observed the following;
- The diaper change foam mat, has a rip and two dirty pieces of scotch tape on it. Licensing provided education that this does not allow for effective sanitizing of the mat.
- a foam mat in one of the play room is ripped.
Corrective Action(s): Ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: Licensing observed the following that are accessible to children;
- The children play on the upstairs patio that has a propane tank, big barbecue and gas fire pit. Licensing provided education that if the children would like to use this area it would need to be made safe.
- Toilet bowl scrubber sitting beside the toilet on the floor without a cover.
- Diaper rash ointment on the diaper change table.
Corrective Action(s): Ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: Upon a review of two staff records, Licensing observed that one staff's certificate has not been verified through the Early Childhood Educator (ECE) registry.
Licensing provided education that all renewed and new certificates need to be verified through the ECE registry.
Corrective Action(s): Ensure that staff records are complete.
Date to be Corrected: July 20, 2022.

STAFFING: 12160 - CCLR s.20(1) - The licensee must not permit a person over the age of 12 to be ordinarily present on the premises of a community care facility while children are present, unless the person is of good character and the licensee has obtained a criminal record check for that person.
Observation: Licensing observed that there is an individual over the age of 12 that opened the door of the community care facility. The Manager informed Licensing the individual sometimes helps out at the facility however, there is no criminal record check (CRC) for the individual. The Manager was unaware that a CRC was required for the individual.
Licensing provided education that any person over the of 12 that is ordinarily present on the premises requires a CRC.
Corrective Action(s): Ensure that CRCs have been obtained for any persons over the age of 12 that are ordinarily present on the premises of the community care facility while children are present.
Date to be Corrected: August 3, 2022.

CARE AND/OR SUPERVISION: 14020 - CCLR s.34(2)(a) - Without limiting subsection (1), a licensee must ensure that (a) children attending a community care facility are divided into groups, with each group having no more children than that permitted in Schedule E.
Observation: Licensing observed the following;
-Licensing asked the Manager how many children were in care and the Manager informed Licensing that there is always only eight children in care which is the maximum capacity of the community care facility. However, upon a review of the attendance record for July 18, 2022, Licensing observed the there were nine children in care.
- There were four days in the months of June and July that there were four children in care under the age of 3 yrs. old.
Licensing provided education that it is very important to ensure that there are never more then eight children in care at any given time.
Corrective Action(s): Ensure that the children attending the community care facility are divided into groups, with each group having no more children than that permitted in Schedule E.

HYGIENE AND COMMUNICABLE DISEASE: 15030 - CCLR s.46(1) - A licensee must establish a program to instruct children in, and to practise the rules of, health and hygiene.
Observation: Licensing observed the following;
- The soap in the bathroom was extremely diluted with water. Licensing has previously provided education to not dilute soap with water.
- A training toilet seat sitting on the floor beside the toilet and touching the toilet bowl scrubber.
-A dirty and smelly cloth that is being used to clean the tables. The Manager removed the cloth. Licensing provided education.
- Children's mats are being storing standing up against each other. The fitted sheets are on the mats and touching each other. The Manager corrected this.
Corrective Action(s): Ensure that a program is established to instruct children in and to practice the rules of health and hygiene.
Date to be Corrected: July 20, 2022.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Upon a review of the attendance records for the month of July, Licensing observed that there was one day that a child was not signed in .
Corrective Action(s): Ensure that attendance records are accurate on a daily basis.

Comments

Summary of Inspection
At the routine inspection conducted on July 19, 2022, there were eight children, a staff and the Manager present. At this inspection the above noted contraventions were identified. The Licensee is required to correct all identified non-compliances by the dates indicated above in the violations section. A written response is to be provided to Licensing on the date specified for Licensing to review that appropriate corrective action has been taken to address all identified non-compliances. As part of this Routine Inspection a Facility Risk Assessment Tool is completed.
The following education/recommendations were provided:
Mats outside ; ensure not curling at the corners to avoid potential tripping.
Cleaning of the facility walls and toys.
Temporary placement and when required
The contents of the inspection report were reviewed with the Manager at the time of the inspection. This report was written off site due to Covid-19 to help promote health and hygiene. A copy of this report and the risk assessment were emailed to the facility.
