Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: During the inspection it was noted that the Manager's name was not posted.
Corrective Action(s): Please ensure the Manager's name is posted in the facility.

LICENSING: 10070 - CCLR s.11(4) - A licensee must display in a prominent place in the community care facility the certificate, or a copy of the certificate, of any educator or assistant employed to work in the community care facility.
Observation: During the inspection the certificates were observed. One staff certificate was expired and one was not currently posted.
Corrective Action(s): Please ensure staff certificates are posted and that the dates are current.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: A phone cord was observed at the children's level. This could cause a potential strangulation hazard. In addition there is no disinfection used on the change table after each diaper change. This could cause a potential for cross contamination between children. This concern was discussed with the staff.
Corrective Action(s): Please ensure a health and safe environment is provided at all times.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: During the inspections I noticed the blinds in the nap room were bent and broken. In addition a cord from the blind was hanging low at child level. This is a repeat contravention from inspection # GSIU-ATYSUT where the Manager mentioned she was in the process of replacing the blinds. In addition their was a crack noted in the change table.
Corrective Action(s): Please make sure the equipment and fixtures are in good repair to ensure the health and safety of children in care and to comply with the legislation.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11180 - CCLR s.16(4)(a) - A licensee must ensure that all indoor and outdoor play materials and equipment accessible to children are (a) suitable for the age and development of the children.
Observation: Licensing observed empty shelves in the play area and an empty book shelf. The children were crawling into the shelves. In discussion with the staff they stated they don't take many toys out as the children take them off the shelves and they place them in the play kitchen. The staff also stated they have talked with the Director about purchasing more materials and resources for the facility.
Corrective Action(s): Please ensure a sufficient amount of age appropriate materials are available for the children and are accessible for them to use. to meet the developmental needs of children from ages 0 to 36 months.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11230 - CCLR s.47 - A licensee must ensure that any heated water accessible to children is heated to no more than 49° Celsius.
Observation: Licensing measured the temperature of the water in the washroom. The temperature was 53.6 degrees Celcius. I spoke to the staff and made recommendations on how to reduce the water temperature. Corrected during the inspection.
Corrective Action(s): Please ensure that the water that is used by the children is heated to no more than 49 degrees Celcius to comply with the legislation.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Licensing observed the staff records for two out of four staff members. Two criminal record checks were present but one was not site specific. A record of application to the Criminal record review board was on the staff record
Corrective Action(s): Please ensure staff records are complete and Criminal record checks are site specific.

POLICIES AND PROCEDURES: 13040 - CCLR s.56(1)(a) - A licensee must keep current records of each of the following: (a) written policies and procedures for the safe release of children.
Observation: The policies and procedures were reviewed. There was no policy present outlining the safe release of children.
Corrective Action(s): Please ensure a policy outlining the safe release of children is created.

POLICIES AND PROCEDURES: 13080 - CCALA s.19 - If a person prepays part of the cost of services provided by a class of community care facilities designated by the Lieutenant Governor in Council, the licensee must, at the time of the prepayment, deliver to the person a written statement setting out the terms and conditions on which a refund of all or any of the prepayment will be made.
Observation: During the inspection the policy and procedures were reviewed. There was no repayment policy
Corrective Action(s): Please ensure a written repayment policy is created and shared with the families outlining the procedure when parents prepay the cost of services. One example may be what the procedure is when parents pay with post dated cheques and withdraw from the facility.

CARE AND/OR SUPERVISION: 14060 - CCLR s.39(1) - A licensee must ensure that children are supervised at all times by a person who is an educator, an assistant or a responsible adult.
Observation: During the inspection it was observed that while one staff was changing one child's diaper 4 children were in the nap room while awake and three children were in another room with no staff supervison. Licensing discussed this concern with the staff and recommended that the children have one nap room and that four children are taken to the washroom to maintain staff to child ratios at all times.
Corrective Action(s): Please ensure the children are supervised all times.

CARE AND/OR SUPERVISION: 14230 - CCLR s.51(1)(b) - A licensee must (b) provide to employees and parents a written statement of the licensee's policy on behavioural guidance.
Observation: During the inspection the policies and procedures were reviewed. No policy on behavioural guidance of children was noted.
Corrective Action(s): Please ensure a policy on behavioural guidance is created and shared with the employees and the parents.

HYGIENE AND COMMUNICABLE DISEASE: 15050 - CCALA s.7(1)(b)(i) - A licensee must do all of the following: (b) operate the community care facility in a manner that will promote (i) the health, safety and dignity of persons in care,
Observation: During the inspection Licensing asked the staff where diaper changing takes place. The staff stated the children are changed in the play area and sometimes are changed in the washroom. This is a repeat contravention from inspection # CGEE-AXZQJD
Corrective Action(s): Please ensure the children's dignity is maintained by changing the cildren's diapers in the washroom.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: Licensing reviewed 4 childrens files out of 8 children's files. One child was missing an MSP number. This is a repeat contravention.
Corrective Action(s): Please ensure all of the children's records are complete.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: During the inspection I asked to view the attendance records. The staff stated the attendance had not been completed for the day. The attendance records were reviewed for the months of January and February. Many departure times were missing. The importance of completing and maintaining attendance records was discussed
Corrective Action(s): Please ensure attendance records including a child's time of arrival and departure are completed on a daily basis when children arrive and depart from the facility.

Comments

At the inspection dated February 6, 2019 there were 8 children and 2 staff present. At this inspection the above noted contraventions were identified . Please ensure a written response is submitted to Licensing by February 20 , 2019 addressing the above contraventions. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.
The following education/recommendations were provided:

A follow up inspection will need to be completed as items identified from a previous inspection have been not been completed.

The Manager was away today. This report was reviewed with the staff prior to signing.
