Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Observed Violations
STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: Licensing observed that a certificate validation was missing on file.
Corrective Action(s): Ensure that the certificate validation is on file.

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation: Licensing observed that for the months of March, July and August 2023, the date in which the fire drills were completed were not recorded, though the manager said that they have all been completed. This is a repeat contravention noted on report #MZIN-CJGVXC.
Corrective Action(s): Ensure that the monthly fire drills are recorded.

RECORDS AND REPORTING: 19050 - CCLR s.56(1)(f) - A licensee must keep current records of each of the following: (f) a log of minor accidents, illnesses and unexpected events involving children, that did not require medical attention and were not reportable incidents described in Schedule H.
Observation: Licensing observed that a record log of minor incidents were not available on-site.
Corrective Action(s): Ensure that minor incidents are logged in a bound book, with the full date.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Licensing observed that the departure time of the children were not recorded on Sept. 12, 2023, and that the arrival and departure time of childen were not recorded on Sept. 13, 2023. Moreover, records did not indicate when children were absent.
This is a repeat contravention noted on reports #MZIN-C5MS3J & #CGEE-BQ3M8R.
Corrective Action(s): Ensure that the arrival, departure and absences of children are recorded on file.

Comments

· Licensing went on-site and attempted to complete a routine inspection on Sept. 11, 2023. However, there was no response at the door at the time.

At the inspection dated Sept. 13, 2023 there were 4 children present, and on Sept. 14, 2023, there were 3 children present. On both days, the manager was on-site and assisted with the inspection. At this inspection, the above noted contraventions were identified. Actions required by the licensee includes a written response. The contraventions noted in this report were reviewed with the facility manager during the inspection.

As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.

The following recommendations/discussions were provided:
- Reportable Incident procedures, which is to be reported within 24 hours. Child care staff are asked to call their Licensing Officer to make the report. If the Licensing Officer is unavailable, please call the Duty Line Licensing Officer.
- Document minor incidents using the incident log bound book, and take note of any illness and unexpected events involving children not requiring medical attention, and that are not reportable incidents as described in Schedule H and staff to initial and write the date after each documentation.
- Check the expiry date of items in the emergency supplies kit
- Remove all items with a DIN # in the first aid kit, as parent’s permission is required before using these items on children. Mild soap and water can be used to clean any minor cuts or scrapes.
- Files and organization
- Storing of bedding procedures
- Online validation steps
