Introduction

An unscheduled inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DLSOP). All areas of the facility were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Licensing observed the following accessible to children in care:
- Fiberglass was protruding from the wall, located within reach of children on the change table.
- A warm kettle was plugged in to the wall in the kitchen with the cord hanging within children’s reach. The concern is the kettle containing hot water may fall on a child. The Manager removed the kettle while Licensing was on site.
- An unsecured television was located on a low shelf. The concern is that the TV may fall on a child. The Manager removed the TV while Licensing was on site.
Corrective Action(s): Ensure a healthy and safe environment is provided at all times.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Licensing reviewed 3 staff files and noted the following:
- 1 staff was missing evidence of 1 character reference
- 1 staff had no evidence of character references
- 1 staff had character references, however no system to indicate they were checked
Corrective Action(s): Ensure character references are obtained prior to employment.

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation: Licensing noted there was no record of a fire drill being completed for August 2021. The Manager said it was practiced, however it was not recorded.
Corrective Action(s): Ensure a record is kept respecting compliance with section 22(2)(b) of the CCLR.

Comments

At this inspection, there were 3 children, 2 staff and the Manager present. At this inspection, the above noted contraventions were identified.
The following was discussed with the Manager:
· Emergency management
· COVID-19 prevention strategies
· Children’s records
· Health and hygiene

The Manager is to correct the contraventions by the dates indicated, and provide a written response to licensing.

As part of the routine inspection, a Facility Risk Assessment Tool was completed.

The inspection report was written off-site due to COVID-19 protocol – all details were reviewed with the Manager prior to writing the report. A copy of the inspection report and risk assessment will be e-mailed to the Manager.
