Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), and the Child Care Licensing Regulations (CCLR), and the Director of Licensing Standards of Practice (DoLSoP). All care categories were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: The door of a wooden toy was taped with duct tape and appeared to be showing signs of wear. Manager stated that they would remove the door.
Corrective Action(s): Please ensure the community care facility and the furniture, equipment and fixtures within it are clean and in good repair.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: During the inspection it was observed:
-Mop bucket, aerosol spray, and cleaning, and rubber gloves were stored in the bathroom that was in use and accessible to children. In the bathroom that was not in use stored cleaning powder in a bucket accessible to children, however this bathroom was not in use. Licensing stated that both bathrooms are designated to the facility.
-The vacuum, and a fan were unplugged with cords accessible to children.
-A staff's personal bag was on a box, accessible to children.
Corrective Action(s): Please ensure to develop a system to ensure children do not have access to any object or substance that may be hazardous to the health and safety of a child.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Review of 3 employee files. 1 file contained a current CRC addressed to another facility.
Corrective Action(s): Please ensure the licensee does not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has met with the person and obtained a criminal record check for the person.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Review of 3 employee files. One file contained no record of immunization.
Corrective Action(s): Please ensure the manager has first met with the person and obtained evidence that the person has compiled with the province's immunization and tuberculosis control programs.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: Review of 3 staff files. 1 file contained an expired validation of certification of an early childhood educator.
Corrective Action(s): Please ensure the licensee must not employ a person in the community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualification], which must be verified by the system maintained by the early childhood educator registry.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Licensing observed no record of departure for the date of August 26, 2021. Additionally when this was corrected the time was the same for each child, however licensing had observed the departure for 5 children had been at different times.
Corrective Action(s): Please ensure to keep for each child a record showing the time of arrival and departure.

Comments

Summary of Inspection:
During today’s inspection, there were 5 children, and the facility manger present. Licensing was accompanied by a student for training purposes.
At this inspection the above noted contraventions were identified. Licensee is required to submit a corrective action plan to address the contraventions.

The following was discussed:
Licensing observed the bedding on the nap cots were removed and stored in individual buckets, while the sheets were left on the bed and stacked. The beds were not labeled. The systems for cleaning and sanitizing bedding were reviewed with the manager. Manager stated they remove the sheets at the end of the day and send them to the facility laundry, and then sanitize the beds. Licensing observed fresh sheet buckets on the counter next to the shelf.
The facility had received a new fridge to store children's lunches. The manager stated she believed that one had come with it. After review there was no thermometer, therefore manager stated she would ensure one would be purchased and placed in the fridge.
The second bathroom was not accessible to children at the time of the inspection. Licensee discussed that there must be 2 sinks and 2 wash basins available for children's use.
