Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP).
All areas of the facility were reviewed for compliance apart from the operation of the school age program.

Contraventions
Previous Inspection - Contraventions observed on FIR #SWAR-AV2QX6 have been corrected.
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Licensing observed the following:
- The main garbage can in the kitchen is missing a lid - this is accessible to children
- The carpet leading into the cubbie area is curled at the edge and presents a tripping hazard. 1 child tripped on it at the time of inspection.
Corrective Action(s): Please provide a safe environment for all children.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: On review of a new staff file, Licensing observed that a criminal record check clearance was not available. manager stated that it was faxed a couple of months ago. Manager was able to locate an electronic copy of the signed application to show Licensing.
Corrective Action(s): As this staff will never work alone, Licensing will accept a health and safety plan from the Licensee which mitigates the risk to children until the clearance arrives. Please also provide a copy to Licensing once received.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: On review of a new staff file, Licensing observed that the file was missing characther references.
Corrective Action(s): Please ensure that a staff is appropriately screened as per Section 19 of the Child Care Licensing Regulations prior to employment

STAFFING: 12200 - CCLR s.22(2)(c) - A licensee must ensure that each employee (c) practices implementing the emergency plan at least once each year.
Observation: On review of drill logs, Licensing observed that the annual emergency evacuation drill was not practiced since November 2017
Corrective Action(s): Please ensure all staff practice the annual drill

STAFFING: 12370 - CCLR s.37(3)(b) - Despite the employee qualifications required by Column 4 of the table in section 1 of Schedule E [group sizes and employee to children ratios], a licensee must replace an absent employee described in Column 1 of the following table who is absent (b) for 30 consecutive days or more with a person described in Column 3 opposite that employee and the row in Column 2 labelled as "≥ 30 days".
Observation: 1 staff on site today is replacing a staff who left on a leave in September 2018. This staff is not qualified as an ECE Assistant which is the minimum requirement. Manager stated that this staff is currently enrolled on a future ECE course.
Corrective Action(s): Please submit an application for staff exemption to enable this staff to continue working at this facility. This will be approved with evidence of enrolment into the ECE program.

CARE AND/OR SUPERVISION: 14020 - CCLR s.34(2)(a) - Without limiting subsection (1), a licensee must ensure that (a) children attending a community care facility are divided into groups, with each group having no more children than that permitted in Schedule E.
Observation: On review of children's files and attendance, licensing observed that one child did not meet the age requirements for the service type. Discussed with the manager who was unaware - this child is a new enrolment.
Corrective Action(s): Licensing assessed no increased risk and requires an application to temporary place this child as well as exemption for the 3rd child under 3 years of age in the group. This will be a short term application to address the non-compliance identified.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Licensing observed that there were only 7 children signed in on the attendance sheet today when there were 10 children in attendance. Manager was made aware.
Corrective Action(s): Please ensure accurate attendance records at all times particularly in the case of an emergency situation

RECORDS AND REPORTING: 19190 - CCLR s.57(3)(a) - A licensee must have in writing from a parent, and maintain at the community care facility, consent (a) to call a medical practitioner or ambulance in case of accident or illness if the parent cannot immediately be reached.
Observation: On review of a random selection of 10 children's files, Licensing observed that 1 was missing emergency consent. Manager was made aware and Licensing acknowledges that all other files were complete.
Corrective Action(s): Please ensure children's files are complete at the time of registration.

Comments

Summary of Inspection

At today’s inspection there were 10 children and 2 staff present. At this inspection the above noted contraventions were identified .

Licensee is required to submit a health and safety plan to Licensing by the end of day today and submit applications for both exemption and temporary placement in relation to above contraventions to address non-compliance identified today.

Licensing will provide the applications by email and will review the documents once submitted and issue approvals based on observations and information gathered at today's inspection.

As part of this Routine Inspection a Facility Risk Assessment Tool was completed and a copy was provided.

The following education/recommendations were provided:
· Promoting Active Play in the program
· Temporary Placements
· Active Supervision
· Lead in the Water/flushing pipes

A follow up will be conducted to observe the school age program as well as further discuss access points for each group with the Licensee
