Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA) and the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). Evidence for this report was based on the licensing officer’s observations, review of the facility records, and information provided by the facility staff at the time of the inspection.

· Nutrition and Food Services
· Program
· Records and Reporting
Live 5210 Kit was provided to the facility at the time if inspection.
As part of this routine inspection a Facility Risk Assessment Tool is completed and a copy is provided. The Risk Assessment includes non-compliance identified during the routine inspection and a 36 month “historical” review of the facility’s compliance operation.

While on site the following was discussed with the Manager:
-Interactions between the child and staff
-Had a discussion about validating staff certificates and showing proof that this was done within the staff's file
-Had a discussion with the staff about keeping children in a chair that should solely be used for eating and not keeping them contained due to behavior.
-The facility is quite busy today and Licensing noted that supervision can be tough when children are constantly going to the washroom when there is only one staff, when the children are in the play room. Discussion was had with the Manager about possibly coming up with a plan when the facility has transition periods where the children had to use the washroom, etc.

Contraventions
Previous Inspection - Contraventions observed on FIR #JMIA-A2ZMCT have been corrected except for those noted on supplementary pages.
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: While on site, the following was observed:
-A child had used the washroom in the potty but the potty was not immediately emptied, the urine was then potentially accessible to the other children in care.
-The facility only has two sinks and no dishwasher on site. When Licensing inquired about washing dishes, it was apparent that the facility was not using the 3 sink method. A discussion was had with the Manager about using a third bucket so that the facility can adequately clean and sanitize dishes and toys.
-The cupboard below the washroom sink was not locked and contained the bathroom brush and some plastic bags.
-The carpet in the main play area has started to ripple and could act as a tripping hazard is it is not addressed.
OUTSIDE:
-Oven burner coil is lying on the ground in the yard.
-There is nails sticking of the wood perimeter that goes around the gravel section of the playground where the wood has separated from one another.
-There is a broken shelf being stored just outside the daycare entrance within the outdoor play space area.
-Some nails are sticking out of the back part of the shed.
Corrective Action(s): Please ensure a healthy and safe environment.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: The following were noted at the time of inspection:
-There are some toys in the yard that need to be removed (i.e. deflated balls).
-There is a large hole in the nap room where the wall is taped.
-The walls are in need of a good cleaning and some of the walls have started to chip.
-The drain in the washroom is slow to drain.
-There is some mold present on the ceiling within the circle room (far right).
Corrective Action(s): Please ensure that the facility is clean and in good repair.

HYGIENE AND COMMUNICABLE DISEASE: 15030 - CCLR s.46(1) - A licensee must establish a program to instruct children in, and to practise the rules of, health and hygiene.
Observation: While Licensing was on site, a child was observed to have used the kitchen sink to wash their hands and Licensing did not observe that the child used soap. While on site, a discussion was had with the Manager about ensuring children are practicing the rules of health and hygiene. The children were then reminded after the discussion that they should ensure that they wash their hands and to ensure that they use soap.
Corrective Action(s): To stop the spread of communicable disease and instill good hygienic practices, the facility should ensure that they practice the rules of health and hygiene.

NUTRITION AND FOOD SERVICES: 17100 - CCLR s.48(4)(c) - A licensee must ensure that children are not (c) left unsupervised while consuming food or drink.
Observation: While on site, a child was left unsupervised with a drink while the staff were tending who a child in the washroom. During this time, the child emptied out their drink onto their tray. A discussion was had with the Manager about ensuring supervision when children are eating and drinking.
Corrective Action(s): Please ensure supervision when children are consuming food and drink.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation: Children's files were reviewed, three were missing enrollment dates.
Corrective Action(s): Please ensure children's files are complete.
Date to be Corrected: October 14, 2016

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: Two children were missing Dr information. Please note that the name and number of the local walk in clinic that they may attend would be acceptable.
Corrective Action(s): Please ensure children's files are complete.
