Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All care categories were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: During the inspection the following was observed inside the facility:
- several board books were placed in a bin on top of the play kitchen. The children were moving the toy kitchen and hiding behind it.
This was corrected during the inspection.
-plastic bags were observed in the washroom at the children's level.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: During the inspection licensing observed the following inside the facility:
-holes in the wall with drywall exposed. This is a repeat contravention from inspection #CLAN-BKZRLK
-Several paint chips were noticed throughout the facility. This is a repeat contravention from inspection #CLAN-BKZRLK
-a lock on the door to the outside area was exposed
-the laminate is chipping around the edges. This may make it difficult to clean and may harbour bacteria.

During the inspection licensing observed the following outside the facility:
- a broken toy in the outdoor play area.
-a plug in the outdoor play area has tape on it
Corrective Action(s): Please ensure the facility and equipment are in good repair.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11050 - CCLR s.14(1) - A licensee, other than a licensee who provides a care program described as Family Child Care or Child-minding, must have for each child at least 3.7 m2 of usable floor area in the community care facility, excluding (a) hallways, (b) built in storage areas, (c) bathrooms, and (d) fixed appliances, or, if not fixed, large appliances that are not normally moved from one area to another.
Observation: The facility is licensed for a maximum of eight children in care. During the inspection licensing observed that the second room that is licensed for children was being used as a storage room. The following items were observed:
-a car seat
-four high chairs
-a table
-four plastic and metal chairs.
-a poinsettia
-a bed
Some items were removed during the inspection
Corrective Action(s): Please ensure the entire area that is licensed for children is used by children and not for storing materials or furniture. The second room must be open when over 4 children are present to ensure there is 3.7 meters square per child for 8 children in care. If the second room is not being used for care than the licensed capacity will be decreased. The second room must contain toys and materials to comply with Schedule G of the CCLR.

STAFFING: 12470 - CCLR s.60(4) - Immediately after a person who was the subject of a character reference is no longer employed by or ordinarily present at the community care facility, a licensee must return all character references to the person, or destroy the character references.
Observation: During the inspection several staff files were observed from staff who are no longer working at the facility.
Corrective Action(s): Please ensure character references are returned or destroyed when an employee is no longer employed at the facility.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: Four children's records of eight were reviewed. One child's record was missing their immunization and the corresponding immunization record. The Director presented evidence of the record. Upon inspection, the dates were not filled in.
Corrective Action(s): Please ensure children's records are complete.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: During the inspection the attendance was reviewed. Five departure times were missing. This is a repeat contravention from inspection # CLAN-B95QBA and #CLAN-BBXNQK and #CLAN-BKZRLK.
Corrective Action(s): Please ensure the attendance records are complete to ensure the health and safety of children in care.

Comments

At the inspection dated December 10, 2021 there were 8 children, two staff and the Director were present. At this inspection the above noted contraventions were identified. Please correct the above noted contraventions by December 27, 2021 unless otherwise specified in the report. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy was sent to the Director.

The following education/recommendations were provided:

-The reportable incident reporting procedure.
-The current COVID-19 protocols that are in place
-Information about preventing lead in water
-Please add more food to the emergency kit. Licensing recommends enough food for a period of 72 hours.

During the inspection a child was observed in a high chair after she finished eating. The child was showing signs that she was ready to leave the high chair. The staff encouraged the child to stay in the highchair until all of the children were finished. A discussion ensued. Recommendations were made. Licensing discussed that children should only be in a highchair while eating and should be removed when they are finished eating.

The inspection findings were reviewed with the Director as the Manager was absent. Due to the COVID-19 pandemic the inspection report and the risk assessment were completed at the Burnaby FHA office. The report was written in 1 hour and this is not included in the report. A copy of these documents were sent to the Director. If you have any questions regarding this report please contact me.
