Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSOP). Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.

The following areas were reviewed:

· Licensing
· Physical Facility

· Policies and Procedures
· Care and Supervision
· Hygiene and Communicable Disease Control
· Medication
· Program
· Records and Reporting

As part of the routine inspection a Facility Risk Assessment Tool is completed and a copy is provided. The Risk Assessment includes non-compliance identified during the routine inspection and a 3 year “historical” review of the facility’s compliance and operation.

Observed Violations
STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Licensing reviewed 2 staff files and observed that both staff were missing criminal record check clearance letters. The manager stated that both staff have criminal record checks from their previous place of employment and the results will be shared with this facility.
Corrective Action(s): Please obtain criminal record checks prior to employment.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Licensing reviewed 2 staff files and observed that both staff were missing record of immunization status.
Corrective Action(s): Please obtain a record of immunization status prior to employment.

STAFFING: 12160 - CCLR s.20(1) - The licensee must not permit a person over the age of 12 to be ordinarily present on the premises of a community care facility while children are present, unless the person is of good character and the licensee has obtained a criminal record check for that person.
Observation: It was identified that an individual who has been ordinarily present at the facility did not have a criminal record check clearance (CRC) letter. The manager stated they were unaware that this individual required a CRC and that this individual is not alone with the children.
Corrective Action(s): Please ensure CRC's for all individuals who are ordinarily present at the community care facility.

Comments

The following was discussed:

Documentation requirements for volunteers;
Information to include in a care plan and how to capture evidence of care plan review (yearly review);
Section 37 of the CCLR (absent employees);
Reportable incident process.

The following was observed:

Active supervision practices during mealtimes, indoor and outdoor play;
Off-site play space plan.

Licensing would like to thank the manager and staff for their time and assistance.

Licensing will need to conduct a follow-up inspection because all newly licensed facilities receive one routine and one follow-up.
