Introduction

Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.

As part of the routine inspection a Facility Risk Assessment Tool is completed and a copy is provided. The Risk Assessment includes non-compliance identified during the routine inspection and a 3 year “historical” review of the facility’s compliance and operation.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: Name of the manager is not posted

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11080 - CCLR s.15(1)(a) - A licensee must supply equipment, furniture and supplies that are (a) of sturdy and safe construction, easy to clean and free from hazards.
Observation: There is a large tv that is located top of a mid height shelf and it can be unsafe if tipped
Corrective Action(s): Please ensure equpment is sturdy and safe.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: One staff person does not have evidence of a CRC

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Staff person immunization status unavailable.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: Staff person Certificate has not been verified.

STAFFING: 12210 - CCLR s.23(1)(a) - A licensee must ensure that children have at all times immediate access to an employee who (a) holds a valid first aid and CPR certificate, provided on completion of a course that meets the requirements of Schedule C.
Observation: For several past weeks, the facility has been operating few hours in the morning without a staff person who has a valid first aid.
Corrective Action(s): Licensing was informed that staff were supposed to take their renewal but class was cancelled, renewal is to occur this weekend. Regardless of the cancellation of course, compliance must be met at all times. There are several children with care plans.

STAFFING: 12260 - CCLR s.29(c) - To qualify for employment in a community care facility as a responsible adult, a person must (c) have completed a course, or a combination of courses, of at least 20 hours duration in child development, guidance, health and safety, or nutrition.
Observation: Staff person does not have the 20 hour professional development requirement
Corrective Action(s): Staff must have the qualifications, this person provides at times the sole care with school age.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must have all of the following: (b) an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: Both of the fire extinguishers yearly service due date was August 2019.
Corrective Action(s): Please ensure equipment is current and up to date.

CARE AND/OR SUPERVISION: 14010 - CCLR s.34(1) - A licensee must ensure that children are adequately supervised by qualified employees in sufficient numbers to meet the needs of each child.
Observation: There are times in the morning, the school age chidlren are supervised by unqualified staff.
Corrective Action(s): Children by must supervised by qualified staff.

PROGRAM: 18150 - DLSOP Active Play - A licensed Preschool care program must ensure the minimum outdoor active play corresponds with the length of time the Preschool program is offered, as outlined below (indoor active play is acceptable when weather is poor or outdoor physical space is limited): Length of Preschool program = Amount of Active play: 1 - 2 hours = 20 minutes, 2 - 3 hours = 30 minutes, 3 - 4 hours = 40 minutes
Observation: Based on discussion with staff and review of the daily program schedule, there is no evidence that regular outdoor time is conducted, today program did not include any outdoor time. The preschool program inforamtion does not include outdoor time. The preschool program operates for 3 hours.
Corrective Action(s): For preschool programs that operate 3 hours, 30 minutes of active play (outdoor if weather permitting) .

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Today's record indicates one child was not signed in and previous records are also indicates children were missed signing in or out.
Corrective Action(s): Records must be maintained at all times.

RECORDS AND REPORTING: 19260 - CCLR s.58(2)(b) - The licensee must (b) review the care plan at least once each year with a parent of the child requiring extra support and any person requested by the parent.
Observation: Yearly review of care plan is not in place

RECORDS AND REPORTING: 19370 - DLSOP Safe Play Space (maintenance of equipment [b3]) - [bullet 3] Keep a log of all inspections, maintenance and repairs.
Observation: Outdoor log of inspection, maintenance and repair is unavailable.
Corrective Action(s): Please ensure records are maintained.

Comments

Licensing could not confirm is the Active and Screen Use policies were updated, previous inspection noted that some changes needed to be done, copy could not be found, please forward a copy.
Licensing provided the Child Care Reporting April 2019 Bulletin.
Please forward a written response to how the above coded violations have been addressed by October 15, 2019. Follow up inspection will be required.
