Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Contraventions
Previous Inspection - Contraventions observed on FIR #IMAY-ASXPLC have been corrected.
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11160 - CCLR s.16(3)(a) - A licensee must ensure that the entire outdoor play area is (a) enclosed in a manner that is suitable for the age and development of children, and will ensure that children are free of harm.
Observation: A 3 tiered yard is used as follows:
The upper level of the yard is described to be designated for the younger children with the lower level used by older children. the lower level is observed to consist of uneven brick surfacing and worn wooden stairs with no barrier/ railing. A gap at the fence poses a risk of injury to the mufti levelled yard below.Some large bolts are protruding within the lower level and broken glass is observed in the upper level.
Corrective Action(s): Please ensure the yard is enclosed in a manner that prevents possible injury, discontinued use of the lower level is required until hazards are addressed. It is noted the upper level is sufficient in size to support the issued capacity.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: observed an exposed electrical outlet accessible to children
Corrective Action(s): please ensure children do not have access to objects which may pose risk of injury.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: Current Certificates of Educators posted however the verification process had not been completed.
Corrective Action(s): please ensure certificates issued are verified using the system identified by the director of licensing.

POLICIES AND PROCEDURES: 13080 - CCALA s.19 - If a person prepays part of the cost of services provided by a class of community care facilities designated by the Lieutenant Governor in Council, the licensee must, at the time of the prepayment, deliver to the person a written statement setting out the terms and conditions on which a refund of all or any of the prepayment will be made.
Observation: At review of the facilities policies it was observed that a repayment policy had not been developed.
Corrective Action(s): please ensure parents are provided with the facilities policies outlining repayment , a resource is provided for your use.

POLICIES AND PROCEDURES: 13100 - DLSOP Active Play - The Licensee must develop and implement an Active Play Policy to engage children in daily active play, consisting of un-facilitated play and facilitated games and activities.
Observation: Policies include that go children outside however do not reference the amount of time spent outdoors in which children are engaged in active play
Corrective Action(s): please ensure Active Play policy is in place which reflects time spent outdoors - Resource provided

POLICIES AND PROCEDURES: 13120 - DLSOP Active Play - The Licensee must develop and implement a Screen Use Policy to guide employees in the use of screen time activities.
Observation: A TV was located within the playroom, Licensee included that children under 2 years would not have screen time. A policy however had not been developed.
Corrective Action(s): please ensure a Screen Time policy is in place and provided to families.

CARE AND/OR SUPERVISION: 14060 - CCLR s.39(1) - A licensee must ensure that children are supervised at all times by a person who is an educator, an assistant or a responsible adult.
Observation: Observed the staff exit a room with 2 children to place them down for nap while 2 children remained in another room in highchairs. It was during this time that the children were not fully supervised and it is further observed that the children were not secured in the chairs with safety belts.The layout of the facility (lack of visible sight lines) creates challenges of ongoing supervision and some solutions were reviewed.
Corrective Action(s): please ensure children are supervised at all times in order to reduce risk of injury , include in your written response your plan of supervision strategies.

HYGIENE AND COMMUNICABLE DISEASE: 15030 - CCLR s.46(1) - A licensee must establish a program to instruct children in, and to practise the rules of, health and hygiene.
Observation: observed diaper changing procedures no handwashing was observed prior to or after changing diapers, children were also not engaged in handwashing practices after changing. Wet Towels are used in replace of handwashing, discussed this practice and the importance of modelling hygiene practices with children. A product was used to sanitize the changing area, in review it was found that this product had expired in 2013 and in order to be effective would require a 10 minutes contact time in addition to being required to mix daily. A child's bottle was stored in the cupboard and contained milk or formula.
Corrective Action(s): please ensure the selection of cleaners used are appropriate to the setting in which they are used, for example this product may be ideal for cleaning walls however determined inappropriate for diaper changing surfaces . Bleach and Water solution when mixed appropriately is effective. please ensure food and drink which requires to be refrigerated is safely stored in order to prevent illness.

NUTRITION AND FOOD SERVICES: 17100 - CCLR s.48(4)(c) - A licensee must ensure that children are not (c) left unsupervised while consuming food or drink.
Observation: Two children seated in highchairs with eating snack while the staff exited the room to access a sink.
Corrective Action(s): Discussed the importance of ensuring children are closely supervised while eating due to added risks associated with chocking.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Current system of attendance does not accurately reflect the time of arrival or departure nor does it indicate whether a child is present or absent.
Corrective Action(s): please ensure an attendance system is developed which provides clear information on a child attendance including times of arrival , departure and whether they are absent or present.

Comments

. At this inspection the above noted contraventions were identified
A follow up inspection will occur due to the contraventions related to supervision and health and hygiene practices.Licensee to provide a supervision plan within the written response which will include how supervision will be maintained at all times.
As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.
The following education/recommendations were provided:
Ø Promoting Active Play
Ø Active Supervision - Resource reviewed and further discussion held pertaining to changes to the physical layout in order to better maintain visibility. Baby gates in place, discussed the practice of stepping over the gates and the risk of injury to both children and staff with this practice. Reviewed solutions such as removal of the gates or a change to the style of gates used.
Ø Lead in the Water - reviewed steps to take in reducing possibility of lead in drinking water ( flushing pipes )
Two licensing staff were present for the inspection for training purposes, the identified contraventions were reviewed by phone, prior to the completion of the report which was written off site. The report to be delivered later in the day due to a busy schedule with acknowledgement of the licensee's assisting children to settle into the daily routine.
