Introduction

A scheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.

As part of the routine inspection a Facility Risk Assessment Tool is completed and a copy is provided. The Risk Assessment includes non-compliance identified during the routine inspection and a 3 year “historical” review of the facility’s compliance and operation.

Contraventions
Previous Inspection - Contraventions observed on FIR ##LJON-A9WU6V have been corrected.
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
LICENSING: 10070 - CCLR s.11(4) - A licensee must display in a prominent place in the community care facility the certificate, or a copy of the certificate, of any educator or assistant employed to work in the community care facility.
Observation: Three early childhood educators are employed at the facility. One of the three staff ECE certificates are posted.
Corrective Action(s): Please post certificates or a copy of the certificate of any educator employed at the facility.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11160 - CCLR s.16(3)(a) - A licensee must ensure that the entire outdoor play area is (a) enclosed in a manner that is suitable for the age and development of children, and will ensure that children are free of harm.
Observation: During an inspection of the outdoor play area it was observed that a section of the fence had fallen down and there was a large gap in the fence. It was also observed that the boards were laying on the ground with nails exposed. A discussion was had with the licensee regarding the fence and she stated that the back yard had not been used in a few days and her husband will fix the fence.
Corrective Action(s): Please ensure that the outdoor play area is enclosed in a manner that will ensure children are free from harm.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11190 - CCLR s.16(4)(b) - A licensee must ensure that all indoor and outdoor play materials and equipment accessible to children are (b) safely constructed, free from hazards and in good repair.
Observation: Licensing observed the lattice along the deck in the outdoor area was showing signs of wear with missing pieces and one deck board was broken in a spot creating a potential tripping hazard.
Corrective Action(s): Please ensure that materials and equipment are in good repair.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: The following hazards were observed in the outdoor play area:
- A broken glass beer bottle was on the ground beside the planter.
- Chicken wire was observed in a pile beside the fence
- 2 plywood boards were leaning against the house with the potential to fall over.
Corrective Action(s): Please ensure that children do not have access to objects or substances that my be hazardous.

HYGIENE AND COMMUNICABLE DISEASE: 15030 - CCLR s.46(1) - A licensee must establish a program to instruct children in, and to practise the rules of, health and hygiene.
Observation: Licensing observed a cloth covering the diaper change pad. A conversation was had with the Licensee about cleaning the diaper change pad after each use.
Corrective Action(s): Please create a procedure to clean diaper change area after each use to promote hygiene.

MEDICATION: 16010 - CCLR s.53(1)(a) - If a licensee has agreed with a parent to give a child any medication prescribed by a medical practitioner or provided by the parent, the licensee and his or her employees must ensure that the medication is (a) administered to the child in the amount and at the times specified by the child's parent or in the child's record or care plan.
Observation: Three permission to administer medication forms were reviewed. The forms were not completed to include the name of the medication, amount and time to be given, or the parents consent in the form of a signature.
Corrective Action(s): Please ensure medication forms are contain all required documentation.

RECORDS AND REPORTING: 19060 - CCLR s.57(1)(a)(b)(c) - A licensee must keep current records for each child showing (a) the information set out in subsection (2),
(b) if applicable, the information and agreements set out in subsections (2.1) and (2.2), and
(c) the consents referred to in subsection (3).
Observation: One child who attends the community care facility does not have a file on site.
Corrective Action(s): Please keep current records for each child attending the community care facility.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Three children were in attendance at the time of the inspection. One of the children was not signed in.
Corrective Action(s): Please keep a record of daily attendance for all children

Comments

Discussed the recent changes to the CCLR as well as the new DOLSP regarding “Active Play” with the facility manager. These changes include:
· Removal of requirement for pre-employment doctor’s note
· Requirement for licensee to validate staff credentials through the ECE Registry website and to keep a record on file related to individual staff ECEA, ECE, I/T ECE and/or SN ECE validations
·Requirement for licensee to develop new policies related to “Active Play” and “Screen Use”.
