Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance with the exception of the emergency supplies.

Observed Violations
LICENSING: 10010 - CCLR s.10(1) - Applicants for licences and licensees must notify a medical health officer immediately of any change in the information provided under section 9.
Observation: During the inspection it was observed that one of the spaces being used by the school age children was not included in the original floor plan that was submitted to Licensing. The Manager stated that the area is used on a regular basis by both the preschool and the school age groups. The Manager stated the preschool uses this space during the March break when the School age program is in session. Another two spaces in the upstairs portion of the facility are licensed for 20 children and 20 children. The Manager stated that another community partner has moved into the space adjacent to these spaces and the community partner is using the washrooms designated for the two school age programs. These two rooms are not currently in use by the facility. In examining the facility records these programs have not been used for the school age program for more than 12 consecutive months. In discussion with the Manager it was recommended that the spaces will no longer be used and the CCFL license will need to be amended. Due to the preschool schedule being in place 3 days prior to spring break 2019 the plan for using the alternate room was revised to include one of the spaces in the upstairs portion of the facility for a two week period and a washroom schedule was developped to ensure the school age and preschool age groups would not mix. This practice must cease as of April 1, 2019.
Corrective Action(s): Please ensure the program is only using the space that is licensed to ensure the health and safety of the children in care. Please submit an application to amend the current license to reflect this change. In addition please ensure that if any changes are made to the original licensed space or capacity, including the inclusion of community partners that Licensing is contacted for approval prior to comencement.

LICENSING: 10070 - CCLR s.11(4) - A licensee must display in a prominent place in the community care facility the certificate, or a copy of the certificate, of any educator or assistant employed to work in the community care facility.
Observation: Licensing observed the ECE certificates posted on the wall . One of the staff member's certificates was missing. In discussion with the Manager she stated one of the staff members had applied for her ECE certificate in October/November but, she was still waiting for it to come in the mail. The staff member reapplied in January.
Corrective Action(s): Please ensure staff certificates are posted in a prominant place in the facility.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Licensing observed eight plug covers missing in the facility.
Corrective Action(s): Please ensure a safe environment is provided to children at all times.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Four staff records out of eight staff records were reviewed. One staff was missing a site specific Criminal record check.
Corrective Action(s): Please ensure all criminal record checks are site specific.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Four staff records of eight staff members were reviewed. One staff member was missing two references.
Corrective Action(s): Please ensure staff records are complete. This is a repeat contravention.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: Four staff records out of eight staff records were reviewed. Two staff members were missing documentation that their certificates were verified.
Corrective Action(s): Please ensure staff records are complete.

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation: Licensing observed the fire drills and emergency evacuation drills documentation. A fire drill was not recorded for the preschool for the month of September and there was no documentation to indicate that an annual emergency evacuation drill had been practiced. in discussion with the Manager she stated that all of the programs do complete an annual evacuation drill. This is a repeat contravention from inspection # DCHG-AHZUNR and inspection # DCHNG-AWKVW8.
Corrective Action(s): Please ensure fire drills are practiced for all programs on a monthly basis and recorded. Please ensure an annual evacuation drill is practiced for all programs and that this is recorded.

CARE AND/OR SUPERVISION: 14010 - CCLR s.34(1) - A licensee must ensure that children are adequately supervised by qualified employees in sufficient numbers to meet the needs of each child.
Observation: During the observation. The school age children were observed playing in the playground. I approached the staff to ask how many children they had in care today. A staff did not know how many children were under their supervision. The concern to the health and safety of the children in care was discussed with the Manager.
Corrective Action(s): Please ensure that staff provide active supervision to ensure that they are aware of how many children are in care at any given time this will ensure that the children are adequately supervised

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: Twenty childrens records out of eighty were reviewed. Twenty children were missing their gender (sex).
Corrective Action(s): Please ensure the children's files are complete.

Comments

At the inspection dated March 13 , 2019 there were 45 children and 6 staff and 1 Manager present. On the second inspection dated March 19, 2019, there were 53 children and 8 staff and 1 Manager present. At this inspection the above noted contraventions were identified. Please submit a written response to Licensing by April 2, 2019 addressing how the above noted contraventions have been corrected. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.

The following education/recommendations were provided:

· Promoting Active Play in the program
· Active Supervision, a handout was given to the Manager
· Lead in the Water
· Reportable incident reporting
· Amending the behaviour and guidance policy
· Removing items with a DIN # from the first aid kit and adding more items.
· Disinfectant solutions

The following resources will be sent to the Manger:
· First aid kit contents list
· Disinfecting resources


A follow up inspection will need to be completed to ensure the changes to the childcare facility capacity and the use of the space are monitored.
