Introduction

An unscheduled inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DLSOP). All areas of the facility were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Licensing observed 2 heavy ladders stacked length ways in the outdoor play area leaning against the side of the swing set. The concern is the ladders may fall on a child.
Corrective Action(s): Ensure a healthy and safe environment is provided at all times.

STAFFING: 12160 - CCLR s.20(1) - The licensee must not permit a person over the age of 12 to be ordinarily present on the premises of a community care facility while children are present, unless the person is of good character and the licensee has obtained a criminal record check for that person.
Observation: 1 person living in the home did not have a criminal record check clearance letter. This is a repeat contravention.
Corrective Action(s): Ensure that each person over the age of 12 ordinarily present on the premise has obtained a criminal record check.

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation: The licensee stated emergency drill and fire drills were completed in 2020, however there were no records available. This is a repeat contravention.
Corrective Action(s): Ensure current records are kept respecting section 22(2)(b) and (c) of the CCLR.

RECORDS AND REPORTING: 19050 - CCLR s.56(1)(f) - A licensee must keep current records of each of the following: (f) a log of minor accidents, illnesses and unexpected events involving children, that did not require medical attention and were not reportable incidents described in Schedule H.
Observation: The facility log book was unavailable for review.
Corrective Action(s): Ensure a current record is kept of minor accidents, illnesses or unexpected events.

RECORDS AND REPORTING: 19060 - CCLR s.57(1)(a)(b)(c) - A licensee must keep current records for each child showing (a) the information set out in subsection (2), (b) if applicable, the information and agreements set out in subsections (2.1) and (2.2), and (c) the consents referred to in subsection (3).
Observation: 1 of 6 children did not have a current file containing records set out in section 57 of the CCLR. The file contained the immunization status and a photo of the child.
Corrective Action(s): Ensure current records are kept for each child.

RECORDS AND REPORTING: 19190 - CCLR s.57(3)(a) - A licensee must have in writing from a parent, and maintain at the community care facility, consent (a) to call a medical practitioner or ambulance in case of accident or illness if the parent cannot immediately be reached.
Observation: Licensing reviewed 6 children’s files and noted 1 did not contain consent to call a medical practitioner or ambulance.
Corrective Action(s): Ensure consent to call a medical practitioner or ambulace in case of accident or illness is available in writing.

RECORDS AND REPORTING: 19320 - CCLR s.59(a) - In respect of a record referred to in this Division, a licensee must (a) keep in a single place at the community care facility the records referred to in sections 56 to 58.
Observation: The facility Screen Time policy was unavailable for review.
Corrective Action(s): Ensure records referred to in sections 56 to 58 are kept in a single place at the community care facility.

Comments

At this inspection, there were 2 children and the Licensee present. At this inspection, the above noted contraventions were identified.
The following was discussed with the Licensee:
· COVID-19 prevention strategies
· Systems in place for maintaining facility information and files
· Usable floor space

The Licensee is to correct the contraventions by the dates indicated, and provide a written response to licensing.

As part of the routine inspection, a Facility Risk Assessment Tool was completed.

The inspection report was written off-site due to COVID-19 protocol – all details were reviewed with the Licensee prior to writing the report. A copy of the inspection report and risk assessment will be e-mailed to the Licensee.
