Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). The facility was inspected for compliance.

Observed Violations
STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation (CORRECTED DURING INSPECTION): Licensing observed that the certificate was not validated for one staff. During the inspection, Licensing showed the facility manager the online procedure for validating staff certificates.
Corrective Action(s): Ensure that certificates are validated for staff.
Date to be Corrected: This was corrected during the inspection.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must: (b) have an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: Although the fire extinguisher appears to still be fully charged, Licensing observed that the fire extinguisher's service date tag was Aug. 22, 2023, and therefore past due for service. This item was also contravened on 17/Sep/2021 on inspection report number MZIN-C72NXR.
Corrective Action(s): Ensure that the fire extinguisher is serviced with a new tag.

RECORDS AND REPORTING: 19320 - CCLR s.59(a) - In respect of a record referred to in this Division, a licensee must (a) keep in a single place at the community care facility the records referred to in sections 56 to 58.
Observation (CORRECTED DURING INSPECTION): Licensing observed that one staff did not have any records or file located at the facility.
Corrective Action(s): Ensure that all staff working at the facility has files and records available on-site.
Date to be Corrected: This was corrected during the inspection.


Comments

At the inspection dated Oct. 03, 2023 there were 21 children and 2 staff present. On Oct. 04, 2023 there were 22 children, 2 staff and a private service provider present. On both days, the manager was on-site and assisted with the inspection. At this inspection, the above noted contraventions were identified. Actions required by the licensee includes a written response. The contraventions noted in this report were reviewed with the facility manager during the inspection.

As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.

The following recommendations/discussions were provided:
- Bound book for minor incidents (addressed by the facility manager during inspection)
- Continue to clean and sanitize the facility including toys and equipment
- Continue to check the expiry date of items in the emergency supplies kit

A copy of this report was sent to the facility.
