Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). Evidence for this report was based on the licensing officer’s observations, review of the facility records, and information provided by the facility staff at the time of the inspection. A Licensing practicum student accompanied the Licensing officer for the inspection today.

Licensing conducted the routine inspection from 10:45 am to 1:00 pm. The report was written at the office to facilitate the Licensing practicum student's learning experience. The report was delivered and reviewed from 4:15 pm - 4:30 pm.

During the inspection the following areas were reviewed:

· Policies and Procedures
· Care and Supervision
· Hygiene and Communicable Disease Control

· Nutrition and Food Services
· Program
· Records and Reporting

As part of this routine inspection a Facility Risk Assessment Tool is completed and a copy is provided. The Risk Assessment includes non-compliance identified during the routine inspection, and a 3 year “historical” review of the facility’s compliance operation.

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Upon inspection of the physical facility, Licensing observed that an uncovered outlet was accessible to the children as it was within the children's reach. Discussions were held regarding ways that this could be addressed.
Corrective Action(s): Please ensure that a healthy and safe environment is maintained at all times while the children are in care.
Date to be Corrected: June 20, 2016.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: Upon review of 5 staff files, Licensing observed that record of a staff's work history was missing. This is a repeat contravention as it was observed on Routine Inspection # 90094088.
Corrective Action(s): Please ensure that obtained from each individual prior to employment, is a record of the individuals work history.

STAFFING: 12280 - CCLR s.34(4)(a) - Despite this section, during the half hour before a care program begins and the half hour after a care program ends, a licensee may permit children who would otherwise be grouped in different care programs, and who are arriving at or leaving the community care facility, to be grouped together and supervised other than as required under Schedule E if (a) the care program is described as Multi-Age Child Care, Group Child Care (Under 36 Months), Group Child Care (30 Months to School Age) or Group Child Care (School Age).
Observation (CORRECTED DURING INSPECTION): Upon Licensing's arrival, Licensing observed that the two service types were mixed together on the playground. Licensing reminded the manager that the procedure for mixing service types pertains to first and last half hours of the day.
Corrective Action(s): Please ensure that sections 34 (4)(a) is applied appropriately.

POLICIES AND PROCEDURES: 13081 - CCLR s.56.1(2)(a) - A licensee must keep (a) a copy of the written statement, referred to in section 19 of the Act, that the licensee delivers to persons who prepay part of the cost of services
Observation: Upon review of 11 children's records, Licensing observed that a copy of the repayment agreement was missing from 2 children's files.
Corrective Action(s): Please keep a copy of the written statement referred to in section 19 of the Act.

POLICIES AND PROCEDURES: 13082 - CCLR s.56.1(2)(b) - A Licensee must keep (b) a current record of each person to whom the written agreement is delivered in accordance with that section [CCALA s.19]
Observation: Upon review of 5 staff files, Licensing observed that a Criminal Record Check (CRC) for one staff member was not addressed to this child care facility.This is a repeat contravention as it was observed on Routine Inspection numbers 90094088 and KSEY-9XXUB9.
Corrective Action(s): Please ensure current CRC's for all staff members. Licensing mentioned that there is an option to share valid CRC's.

RECORDS AND REPORTING: 19370 - DLSOP Safe Play Space (maintenance of equipment [b3]) - [bullet 3] Keep a log of all inspections, maintenance and repairs.
Observation: Licensing observed that a log has not been created and maintained to document inspections, maintenance and repairs conducted on the designated outdoor play space. The manager stated that a visual check of the playground is conducted daily.
This is a repeat contravention as it was observed on Routine Inspection number 90094088.
Corrective Action(s): Please ensure a log of all inspections, maintenance and repairs is maintained.

Comments

During the inspection, Licensing observed part of free play and lunch time.

During free play:

Some children were playing on the outdoor play equipment.
Some children were riding bikes outside.
Some children were reading a story inside.
Some children were playing inside a tent.
Staff members were engaged with children in their play.

During lunch time:

All children washed their hands prior to lunch.
All children sat down while eating.
All children ate their lunch on their own.
Staff supervised children while they were eating.

The following was discussed with the manager:

Discussions were held regarding the minor incident log book. Although it is not a requirement Licensing suggested that staff members sign their minor incident entries in order to better identify the writer.
Discussions were held regarding care plans and Licensing reminded the manager to review the care plans with the parents at least once a year.
Discussions were held regarding Live 5210.
