Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DLP). Evidence for this report was based on the licensing Officers observations, review of the facility records and information provided by the facility staff at the time of inspection.
The following areas were reviewed: Licensing, Physical Facility, Staffing, Policies & Procedures, Care & Supervision, Hygiene and Communicable Disease Control, Medication, Nutrition and Food Services, Programming, Records and Reporting
As part of the Routine Inspection a Facility Risk Assessment is completed and a copy is provided. The Risk Assessment includes non-compliance identified during the routine inspection and a 3 year “historical” review of the facility’s compliance and operation .environment

Contraventions
Previous Inspection - Contraventions observed on FIR # have been corrected except for those noted on supplementary pages.
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: Licensing observed that several books that are worn and not in good repair - no covers or are ripped.
Corrective Action(s): Ensure that the materials are clean and in good repair.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: A review of 4 staff files showed that one is missing an immunization record.
Corrective Action(s): Ensure immunization records are in place for each staff.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: A review of 4 staff files shows that there are no verifications on file.
Corrective Action(s): Ensure ECE and ECEA certificates are verified.

CARE AND/OR SUPERVISION: 14020 - CCLR s.34(2)(a) - Without limiting subsection (1), a licensee must ensure that (a) children attending a community care facility are divided into groups, with each group having no more children than that permitted in Schedule E.
Observation: Upon arrival there were 3 children in care who are too old for this Group Child Care 30 months to school age program (grade 1, grade 2 and older). Staff stated that these were her own children attending the program during spring break.

Staff stated that there are also school age children (grade one and above) who attend the program in the morning and afternoon on a regular basis.
Corrective Action(s): Ensure that children who attend this facility meet the age requirements.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: A review of 6 children's records showed that 1 did not have a record or declaration of immunization status.
Corrective Action(s): Ensure children's records are complete.

RECORDS AND REPORTING: 19130 - CCLR s.57(2)(g) - A licensee must keep, for each child, a record showing the following information: (g) any notification of a parent, emergency contact or medical health officer made under section 55 [notification of illness or injury].
Observation: A review of 6 children's records shows that two did not have emergency contacts.
Corrective Action(s): Ensre children's records are complete

Comments

Licensing observed that there were minimal materials on the shelf for the children. Staff stated that they were trading out the toys and that there were more toys in a storage room.

The children were seen to play outside upon arrival, play with connecting materials, coloring, play with dramatic play, laugh and smile, engage socially, look at books and eat a healthy snack. The staff were helpful with this inspection, responded quickly to the needs of children, play with the children on the floor, promote pro social behaviors (sharing feelings), clean tables and calling children in a gentle voice.
