Introduction

All care categories were inspected during an unscheduled routine inspection to assess compliance w/:
• the Community Care & Assisted Living Act (CCALA)
• the Child Care Licensing Regulation (CCLR)
• relevant Director of Licensing Standards of Practices (DLSP)

Contraventions
Previous Inspection - Not Applicable
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11190 - CCLR s.16(4)(b) - A licensee must ensure that all indoor and outdoor play materials and equipment accessible to children are (b) safely constructed, free from hazards and in good repair.
Observation: A panel of fencing was detached from the post, resulting in a gap.
Corrective Action(s): Fencing must be secure to ensure that children can't escape.

STAFFING: 12150 - CCLR s.19(4)(b) - A licensee must not employ a person in a community care facility as (b) a responsible adult unless the person has the qualifications required under Division 2 [Employee Qualifications].
Observation: *Repeat violation from FIR #CGEE-AZUQ3E (18/Jun/2018)*
An employee has only taken 10/20 hours of RA courses.
Corrective Action(s): The employee must complete his remaining 10 hours of RA courses in child development, guidance, health & safety, or nutrition.

STAFFING: 12260 - CCLR s.29(c) - To qualify for employment in a community care facility as a responsible adult, a person must (c) have completed a course, or a combination of courses, of at least 20 hours duration in child development, guidance, health and safety, or nutrition.

An employee has only taken 10/20 hours of RA courses.
Corrective Action(s): The employee must complete his remaining 10 hours of RA courses in child development, guidance, health & safety, or nutrition.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must: (b) have an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: The fire extinguisher required servicing in Mar/2022.
Corrective Action(s): The fire extinguisher must be serviced by the date indicated on the service tag.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation: *Repeat violation from FIR #CGEE-AM9NZF (11/May/2017) & FIR #CGEE-AZUQ33 (18/Jun/2018)*
5 children's start dates were incomplete.
Corrective Action(s): All requirements of s. 57 are required by children's 1st day of care.

Summary of FIR #CGEE-CDERNN (12/Apr/2022)

5 violations were observed today, in which corrective action includes:
• repairing the outdoor play space's fencing
• obtaining servicing for the fire extinguisher
• fulfilling an employee's training hours
• obtaining children documentation

CCFL discussed key points from the BCCDC's "Public Health Guidance for Child Care Settings" (http://www.bccdc.ca/Health-Info-Site/Documents/COVID_public_guidance/Guidance_Child_Care.pdf).

CCFL reviewed the inspection w/ the manager; however, this report & the facility risk assessment were completed @ the Burnaby Health Protection office & emailed to the manager on 12/Apr/2022.
