Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.
The following areas were reviewed:
· Licensing, Physical Facility, Staffing, Polices & Procedures, Care & Supervision, Hygiene and Communicable Disease Control, Medication, Nutrition and Food Services, Program, Records and Reporting
As part of the routine inspection a Facility Risk Assessment Tool is completed and a copy is provided. The Risk Assessment includes non-compliance identified during the routine inspection and a 3 year “historical” review of the facility’s compliance and operation.

Contraventions
Previous Inspection - Contraventions observed on FIR #KMBH-ANRTP8 have been corrected except for those noted on supplementary pages.
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: The name of the Manager is not posted in the facility
Corrective Action(s): Please ensure to post the name of the Manager in the facility
Date to be Corrected: June 8, 2018

LICENSING: 10070 - CCLR s.11(4) - A licensee must display in a prominent place in the community care facility the certificate, or a copy of the certificate, of any educator or assistant employed to work in the community care facility.
Observation: One staff did not have their ECE license to practice posted
Corrective Action(s): Please ensure to post certificates for the staff who regularly work at the facility

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: There was a table in the daycare space that is showing signs of wear and tear. The wood is starting to chip which would make disinfecting difficult.
Corrective Action(s): Please ensrue that all furniture and equipment is in good repair and safe for children to use. Any equipment that is showing signs of disrepair should be removed from the centre. Duct tape is a temporary solution so should not be used as a permanent solution for repairing items.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: One staff file has an expired criminal record check on file.
Corrective Action(s): Please ensure to have valid criminal record checks on file for each staff. This staff cannot work alone with children until she has a clear check on file.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: One staff file was missing validation of the ECE Certificate
Corrective Action(s): Please ensure to have certificate validation on file for each staff

STAFFING: 12430 - CCLR s.56(1)(b) - A licensee must keep current records of each of the following: (b) for each employee, the records required under section 19 (1) [character and skill requirements].
Observation: There was one staff on site who did not have a file on site for review
Corrective Action(s): Please ensure to have a staff file on site for each staff who works at the facility

POLICIES AND PROCEDURES: 13060 - CCLR s.56(1)(d) - A licensee must keep current records of each of the following: (d) written policies and procedures that are intended to guide employees in the care and supervision of children.
Observation: An active play policy and screen time policy was not available for review
Corrective Action(s): Please ensure to have these 2 policies in writing and share them with parents

POLICIES AND PROCEDURES: 13070 - CCLR s.56(1)(e) - A licensee must keep current records of each of the following: (e) written policies and procedures respecting food and drink to be given to children.
Observation: A nutrition policy was not available for review; the staff was able to verbally state what it was
Corrective Action(s): Please ensure to have this policy in writing

RECORDS AND REPORTING: 19250 - CCLR s.58(2)(a) - The licensee must (a) develop the care plan in consultation with a parent of the child requiring extra support and any person requested by the parent.
Observation: It appers there are a few children who require a care plan to be in place. There is a list of these children's name with a short description of the issue and what to do.
Corrective Action(s): Please ensure to have a detailed plan in place that is developed in consultation with the parents and reviewed annually. This plan needs to include the symptoms to look for and action to be taken. This is to be done for life threatening or potentially life threatening issues.

Comments

Discussions occurred with the Staff about the following:

- updating the information in the child release policy in regards to releasing to a parent
- updating any phone numbers for Licensing as some of the ones listed are no longer accurate
- care plans for children who have an allergy
- posting all regular staff certificates
- reminder for staff criminal record checks and ECE license to practice that will be expiring this year; give enough time to apply for renewal
- posting the name of the Manager
- recording attendance for the preschool program

A response in writing is required to be submitted to Licensing by the date below, outlining how the contravention(s) have been addressed.

This inspection was reviewed with the ECE staff on site.
