Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: Licensing observed the following items outdoors in the play area, which was within reach of children:
- Two rusted nails sticking out of the concrete near the ground. A staff took a picture of this item and said that the facility manager will be informed.
- One rusted gardening snipping tool, which was hanging on a furniture outdoors. This item was removed by a staff during the inspection, and a staff took a picture of this item to show the facility manager.
Corrective Action(s): Ensure that there are no objects accessible to children that may be hazardous to their health or safety.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: It was observed that for one staff, although there is a police clearance documentation on file, a Criminal Record Check from the Criminal Records Review Board is required, and should be under the name of the facility. This is a repeat contravention on report #MZIN-CP3VPU - Feb. 15, 2023.
Corrective Action(s): Ensure that the CRC record is completed as per instructions and filed.

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation: Licensing observed that there was no record of the 2023 emergency drill on file at the facility. This is a repeat contravention on report #MZIN-CCCUFS - Mar. 07, 2022.
Corrective Action(s): Emergency drills are to be completed annually, recorded and dated.

Comments

ยท Licensing went on-site and attempted to complete a routine inspection on Jan. 2, 2024. However, there was no response at the door at the time.

At the inspection dated Jan. 31, 2024 there were 6 children and 2 staff present. At this inspection, the above noted contraventions were identified. Actions required by the licensee includes a written response. The contraventions noted in this report were reviewed with the facility during the inspection.

As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.

The following recommendations/discussions were provided:
- Reportable Incident procedures, which is to be reported within 24 hours. Child care staff are asked to call their Licensing Officer to make the report. If the Licensing Officer is unavailable, please call the Duty Line Licensing Officer.
- Continue to document minor incidents using the incident log bound book, and take note of any illness and unexpected events involving children not requiring medical attention, and that are not reportable incidents as described in Schedule H, and staff to initial and write the date after each documentation.
- Continue to clean and sanitize the facility including toys and equipment
- Continue to check the expiry date of items in the emergency supplies kit
- Staff files documentation and procedures
- Screen time policy and procedures
