Introduction

A scheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSOP).
This inspection was conducted during the Covid-19 pandemic. Covid-19 prevention strategies were noted and discussed.

Observed Violations
LICENSING: 10070 - CCLR s.11(4) - A licensee must display in a prominent place in the community care facility the certificate, or a copy of the certificate, of any educator or assistant employed to work in the community care facility.
Observation: Licensing noted 1 staff certificate not posted.
Corrective Action(s): Please ensure a copy of staff's certificate is displayed in a prominent place in the community care facility.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: A selection of staff files reviewed. Out of the 3 reviewed 2 staff did not have a criminal record check. The Licensee contact stated CRC's have been completed for the staff, they are just not at the facility. A copy will be emailed to Licensing by the end of the day.
Corrective Action(s): Please ensure a criminal record check is on file for all employees.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: A selection of staff files were reviewed. Out of the 3 reviewed 1 did not contain character references.
Corrective Action(s): Please ensure character references in respect of the staff is on file.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: A selection of staff files were reviewed. Out of the 3 reviewed, 2 did not have a immunization record.
Corrective Action(s): Please ensure there is evidence that a staff has complied with the Province's immunization and tuberculosis control program.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: A selection of staff files were reviewed, out of the 3 reviewed 1 did not have a validation.
Corrective Action(s): Please ensure staff certificates are verified by the licensee using a system established and maintained by the director of the early childhood educator registry.

RECORDS AND REPORTING: 19320 - CCLR s.59(a) - In respect of a record referred to in this Division, a licensee must (a) keep in a single place at the community care facility the records referred to in sections 56 to 58.
Observation: Licensing noted the Licensee contact did not have any records on site for review. The Licensee contact was in ratio a few times in this month.
Corrective Action(s): Please ensure records referred to in sections 56 to 58 are on site for all employees.

Comments

At the inspection dated September 23, 2020 there were 5 children and 2 adults present.
Action required by the licensee includes providing a written response by September 30, 2020.
Actions required by licensing include review the written response. Due to the nature of the contraventions a follow-up inspection will be conducted.
Due to Covid-19 no signatures were obtained for this report. The report was written at the CCFL office and emailed to the Manager.

As part of the routine inspection a Facility Risk Assessment Tool is completed and a copy is provided. The Risk Assessment includes non-compliance identified during the routine inspection and a 3 year “historical” review of the facility’s compliance and operation.

The following discussions were had:
- Licensing observed bleach solution was sprayed on the tables and immediately wiped off. A discussion was had with the Manager about leaving the solution on the table to air dry or wiping it away after 2-3 minutes to ensure proper sanitization.
- Covid-19 Infection Control Assessment completed
